AN ACT relating to regional transportation commissions; revising 
provisions relating to the security in operations of a 
regional transportation commission; and providing other 
matters properly relating thereto. 
Legislative Counsel’s Digest: 
 Under existing law, a board of county commissioners may by ordinance create 1 
a regional transportation commission if a streets and highways plan has been 2 
adopted as part of the master plan by the county or regional planning commission. 3 
(NRS 277A.170) Existing law authorizes a regional transportation commission to 4 
provide for and maintain such security in operations as is necessary for the 5 
protection of persons and property under its jurisdiction and control. (NRS 6 
277A.260) Existing law further provides that it is a misdemeanor for a person to 7 
willfully use profane, offensive or indecent language or engage in any quarrel in 8 
any public conveyance, or interfere with or annoy any passenger therein, or fail to 9 
leave any such conveyance upon demand after having refused to pay the proper 10 
fare. (NRS 203.100)  11 
 Section 1 of this bill authorizes any designated security personnel employed by 12 
a regional transportation commission to remove from a vehicle or other property of 13 
the commission any person who is engaged in any such conduct. 14 
 
 
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN 
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: 
 
 Section 1.  NRS 277A.260 is hereby amended to read as 1 
follows: 2 
 277A.260 1. A commission may: 3

 (a) Provide for and maintain such security in operations as is 1 
necessary for the protection of persons and property under its 2 
jurisdiction and control [.] , including, without limitation, 3 
authorizing any designated security personnel employed by the 4 
commission to remove from a vehicle or other property of the 5 
commission any person who is engaged in conduct which 6 
constitutes a violation of the provisions of NRS 203.100. 7 
 (b) Employ professional, technical, clerical and other personnel 8 
necessary to carry out the provisions of this chapter. 9 
 (c) Establish fines for a passenger who refuses to: 10 
  (1) Pay or otherwise fails to pay the proper fare to ride on the 11 
public transit system established and operated by the commission; or 12 
  (2) Comply with a regional or statewide health and safety 13 
standard or mandate. 14 
 If the commission establishes such fines, the commission may 15 
establish procedures that provide for the issuance and collection of 16 
the fines.  17 
 2.  The commission or any person who contracts with the 18 
commission to operate the public transit system shall: 19 
 (a) Maintain, in accordance with all applicable provisions of 20 
state and federal law, any audio or video recording that: 21 
  (1) Is used as evidence in a disciplinary action involving an 22 
employee of any person who contracts with the commission to 23 
operate the public transit system; or  24 
  (2) Contains an incident on the public transit system that 25 
results in an injury to an employee of a person who contracts with 26 
the commission to operate the public transit system. 27 
 (b) Upon the request of an employee organization that is the 28 
exclusive bargaining agent of the employees of a person who 29 
contracts with the commission to operate the public transit system, 30 
provide the employee organization with any audio or video 31 
recording that: 32 
  (1) Is used as evidence in a disciplinary action involving an 33 
employee of any person who contracts with the commission to 34 
operate the public transit system; or 35 
  (2) Contains an incident on the public transit system that 36 
results in an injury to an employee of a person who contracts with 37 
the commission to operate the public transit system, provided that 38 
the commission and the person who contracts with the commission 39 
to operate the public transit system receive a written request by the 40 
employee organization for the audio or video recording within 10 41 
calendar days of the incident. 42
