AN ACT relating to Medicaid; requiring the establishment of a specific billing category and rates of reimbursement for certain clinics that provide mental health care to persons enrolled in Medicaid; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Existing law requires the Department of Health and Human Services to 1 administer the Medicaid program. (NRS 422.270) This bill requires the Division of 2 Health Care Financing and Policy of the Department to establish: (1) a specific 3 category of provider for the purposes of billing and reimbursement under Medicaid 4 for certain clinics that provide education and training to students of certain mental 5 health professions; and (2) all-inclusive per diem rates of reimbursement under 6 Medicaid for services provided by a trainee during a visit to such a clinic, including 7 certain circumstances where services are provided by the clinic at a location other 8 than the clinic. 9 THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. 1. On or before October 1, 2025, the Division of 1 Health Care Financing and Policy of the Department of Health and 2 Human Services shall, to the extent that federal participation is 3 available: 4 (a) Amend the Medicaid Services Manual to create a specific 5 billing category for clinics operated by an accredited university 6 within this State or pursuant to a faculty practice plan to which such 7 – 2 – - *SB353_R1* a university is a party under the direction of a physician licensed 1 pursuant to chapter 630 or 633 of NRS that: 2 (1) Provide mental or behavioral health care to persons 3 enrolled in Medicaid; and 4 (2) Provide education and training to trainees completing a 5 degree, supervised clinical hours or other requirements necessary for 6 the issuance of a registration, certificate or license, as applicable, as 7 a mental or behavioral health professional; 8 (b) Establish an all-inclusive per diem rate of reimbursement 9 under Medicaid for services provided by a trainee, other than a 10 trainee seeking a license to practice medicine as a psychiatrist or a 11 license to practice as an advanced practice registered nurse who 12 provides psychiatric services, at a clinic described in paragraph (a); 13 and 14 (c) Establish an all-inclusive per diem rate of reimbursement 15 under Medicaid for services provided by a trainee seeking a license 16 to practice medicine as a psychiatrist or a license to practice as an 17 advanced practice registered nurse who provides psychiatric 18 services, at a clinic described in paragraph (a). 19 2. The per diem rates of reimbursement provided pursuant to 20 paragraphs (b) and (c) of subsection 1 must be provided for services 21 provided: 22 (a) At a clinic described in paragraph (a) of subsection 1; 23 (b) Through a mobile clinic owned or operated by a clinic 24 described in paragraph (a) of subsection 1; 25 (c) Outside a clinic described in paragraph (a) of subsection 1 to 26 recipients of Medicaid who do not reside in a permanent dwelling or 27 do not have a fixed mailing address; or 28 (d) By a clinic described in paragraph (a) of subsection 1 29 through telehealth, as defined in NRS 629.515. 30 3. The Department shall: 31 (a) Apply to the Secretary of Health and Human Services for 32 any waiver of federal law, apply for any amendment of the State 33 Plan for Medicaid or request any other federal authority that is 34 necessary to carry out the requirements of this section. 35 (b) Fully cooperate in good faith with the Federal Government 36 during the application process to satisfy the requirements of the 37 Federal Government for obtaining a waiver, amendment or other 38 federal authority pursuant to paragraph (a). 39 4. Any application submitted pursuant to paragraph (a) of 40 subsection 3 must be supported using methods for determining 41 reimbursement rates accepted by the Secretary. 42 5. As used in this section: 43 (a) “Faculty practice plan” means an agreement with an 44 institution of higher education which provides for the continued 45 – 3 – - *SB353_R1* practice of and the performance of research and education by a 1 faculty member of the institution of higher education. 2 (b) “Mental or behavioral health professional” means a person 3 who is: 4 (1) Licensed, certified or registered pursuant to chapter 641, 5 641A, 641B, 641C or 641D of NRS; or 6 (2) Licensed as a physician, physician assistant or advanced 7 practice registered nurse who practices in psychiatry, addiction 8 medicine or another specialty relating to behavioral health. 9 (c) “Trainee” means a person seeking licensure, certification or 10 registration as a mental or behavioral health professional who is 11 engaging in supervised practice required to obtain such licensure, 12 certification or registration. The term includes, without limitation: 13 (1) A student enrolled in an accredited mental or behavioral 14 health program to obtain a graduate degree who is participating in a 15 supervised practicum or internship; and 16 (2) A person who has completed the academic requirements 17 for licensure, certification or registration and is obtaining hours of 18 supervised practice required by law or regulation for licensure, 19 certification or registration. 20 Sec. 2.
