AN ACT relating to business; requiring the governing body of a county and incorporated city to take certain actions relating to the establishment of a regional business license; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Existing law authorizes a board of county commissioners of a county or 1 governing body of a city to regulate all character of lawful trades, callings, 2 industries, occupations, professions and business conducted within its county or 3 city, as applicable. (NRS 244.335, 266.355, 268.095) Existing law also requires 4 certain boards of county commissioners and governing bodies of a city to enter into 5 an agreement to establish a multijurisdictional business license for certain 6 contractors. (NRS 244.33501, 268.0951) Sections 1 and 2 of this bill require each 7 board of county commissioners and each governing body of an incorporated city to 8 adopt a model ordinance for the establishment of a regional business license and 9 sets forth certain requirements for such a model ordinance, including requiring the 10 model ordinance to establish: (1) the proposed boundaries of the region in which 11 the regional business license is valid; and (2) proposed categories of businesses for 12 which a regional business license will be issued. 13 Sections 1 and 2 also require each board of county commissioners and each 14 governing body of an incorporated city to: (1) cooperate with each other board of 15 county commissioners and governing body of an incorporated city in the proposed 16 region to determine whether the boards and governing bodies should enter into an 17 agreement to establish such a regional business license for any specified category 18 of business; and (2) consider certain factors relating to the similarity of any existing 19 county or city requirements for such businesses when determining whether to enter 20 into such an agreement. Lastly, sections 1 and 2 require that, if the board of county 21 commissioners and governing body of an incorporated city determine to enter into 22 an agreement to establish a regional business license, each board and governing 23 body shall: (1) establish by ordinance a system for issuing the regional business 24 – 2 – - *SB373* license; and (2) integrate the application for the regional business license with the 25 state business portal. 26 THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. Chapter 244 of NRS is hereby amended by adding 1 thereto a new section to read as follows: 2 1. Each board of county commissioners shall adopt a model 3 ordinance for the establishment of a regional business license 4 within the region, which must, without limitation: 5 (a) Establish the boundaries of the proposed region and each 6 incorporated city that is located within the boundaries of the 7 proposed region; 8 (b) Establish a system for issuing a regional business license 9 for categories of businesses set forth in the model ordinance to 10 engage in such business within the boundaries of the proposed 11 region; 12 (c) Include the requirements for obtaining the regional 13 business license; 14 (d) Include the fees for the issuance and renewal of the 15 regional business license; and 16 (e) Include any other requirement necessary to establish the 17 system for issuing the regional business license. 18 2. Each board of county commissioners shall cooperate with 19 each other board of county commissioners and governing body of 20 each incorporated city in the region proposed in the model 21 ordinance adopted pursuant to subsection 1 or section 2 of this 22 act, as applicable, to determine whether the boards of county 23 commissioners and governing bodies, as applicable, should enter 24 into an agreement in accordance with the provisions of NRS 25 277.080 to 277.180, inclusive, to establish a regional business 26 license for any specified category of business in accordance with 27 the model ordinance adopted pursuant to subsection 1 or section 2 28 of this act, as applicable. 29 3. In determining whether to enter into an agreement 30 pursuant to subsection 2 to establish a regional business license 31 for a specified category of business, the board of county 32 commissioners and governing bodies, as applicable, shall consider 33 whether the existing requirements of the county or incorporated 34 city for any business that falls within the proposed category: 35 (a) Provide for the same or substantially similar fees for an 36 application for or an application to renew the existing license for 37 that business; 38 – 3 – - *SB373* (b) Establish the same or substantially similar renewal periods 1 for the existing license for that business; and 2 (c) Regulate the business in the same or a substantially similar 3 manner with respect to any time, place or manner requirements. 4 4. If a board of county commissioners determines to enter 5 into an agreement pursuant to subsection 2 with any other board 6 of county commissioners or governing body of an incorporated 7 city to create a regional business license: 8 (a) The agreement must set forth the purposes, powers, rights, 9 obligations and responsibilities, financial and otherwise, of the 10 county and each incorporated city that enters into the agreement; 11 (b) The board of county commissioners shall establish by 12 ordinance a system for issuing such a regional business license 13 that authorizes a person that operates a business in the specified 14 category of business to engage in that business within each county 15 and each incorporated city located in the region and in which the 16 person intends to conduct business; 17 (c) The issuance of the regional business license must comply 18 with the requirements of NRS 244.33506, 244.33507 and 19 244.33508; and 20 (d) The board of county commissioners and each other board 21 of county commissioners and governing body, as applicable, shall 22 integrate the application for the regional business license with the 23 state business portal pursuant to paragraph (c) of subsection 3 of 24 NRS 75A.100. 25 Sec. 2. Chapter 268 of NRS is hereby amended by adding 26 thereto a new section to read as follows: 27 1. Each governing body of an incorporated city shall adopt a 28 model ordinance for the establishment of a regional business 29 license within the region, which must, without limitation: 30 (a) Establish the boundaries of the proposed region and each 31 county or incorporated city that is located within the boundaries of 32 the proposed region; 33 (b) Establish a system for issuing a regional business license 34 for categories of businesses set forth in the model ordinance to 35 engage in such business within the boundaries of the proposed 36 region; 37 (c) Include the requirements for obtaining the regional 38 business license; 39 (d) Include the fees for the issuance and renewal of the 40 regional business license; and 41 (e) Include any other requirement necessary to establish the 42 system for issuing the regional business license. 43 2. Each governing body of an incorporated city shall 44 cooperate with each other governing body of an incorporated city 45 – 4 – - *SB373* and board of county commissioners in the region proposed in the 1 model ordinance adopted pursuant to subsection 1 or section 1 of 2 this act, as applicable, to determine whether the governing bodies 3 and boards of county commissioners, as applicable, should enter 4 into an agreement in accordance with the provisions of NRS 5 277.080 to 277.180, inclusive, to establish a regional business 6 license for any specified category of business in accordance with 7 the model ordinance adopted pursuant to subsection 1 or section 1 8 of this act, as applicable. 9 3. In determining whether to enter into an agreement 10 pursuant to subsection 2 to establish a regional business license 11 for a specified category of business, the governing bodies and 12 boards of county commissioners, as applicable, shall consider 13 whether the existing requirements of the incorporated city or 14 county for any business that falls within the proposed category: 15 (a) Provide for the same or substantially similar fees for an 16 application for or an application to renew the existing license for 17 that business; 18 (b) Establish the same or substantially similar renewal periods 19 for the existing license for that business; and 20 (c) Regulate the business in the same or a substantially similar 21 manner with respect to any time, place or manner requirements. 22 4. If a governing body determines to enter into an agreement 23 pursuant to subsection 2 with any other governing body or board 24 of county commissioners to create a regional business license: 25 (a) The agreement must set forth the purposes, powers, rights, 26 obligations and responsibilities, financial and otherwise, of the 27 county and each incorporated city that enters into the agreement; 28 (b) The governing body shall establish by ordinance a system 29 for issuing such a regional business license that authorizes a 30 person that operates a business in the specified category of 31 business to engage in that business within each county and each 32 incorporated city located in the region and in which the person 33 intends to conduct business; 34 (c) The issuance of the regional business license must comply 35 with the requirements of NRS 266.358, 266.362 and 266.368; and 36 (d) The governing body and each other governing body and 37 board of county commissioners, as applicable, shall integrate the 38 application for the regional business license with the state 39 business portal pursuant to paragraph (c) of subsection 3 of 40 NRS 75A.100. 41 H
