AN ACT relating to business; requiring the governing body of certain counties and incorporated cities to take certain actions relating to the establishment of a multi- jurisdictional business license; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Existing law authorizes a board of county commissioners of a county or 1 governing body of a city to regulate all character of lawful trades, callings, 2 industries, occupations, professions and business conducted within its county or 3 city, as applicable. (NRS 244.335, 266.355, 268.095) Existing law also requires 4 certain boards of county commissioners and governing bodies of a city to enter into 5 an agreement to establish a multijurisdictional business license for certain 6 contractors. (NRS 244.33501, 268.0951) Sections 1 and 2 of this bill require, in a 7 county whose population is 700,000 or more (currently only Clark County), the 8 board of county commissioners and each governing body of an incorporated city in 9 the county to adopt an ordinance for the establishment of a multi-jurisdictional 10 business license and set forth certain requirements for such an ordinance, including 11 requiring the ordinance to establish the proposed categories of businesses for which 12 a multi-jurisdictional business license will be issued. 13 Sections 1 and 2 also require the board of county commissioners and each 14 governing body of an incorporated city to: (1) cooperate with the board of county 15 commissioners and each governing body of an incorporated city in the county to 16 enter into an agreement to establish such a multi-jurisdictional business license for 17 any specified category of business; and (2) consider certain factors relating to the 18 similarity of any existing county or city requirements for such businesses when 19 entering into such an agreement. Lastly, sections 1 and 2 require that each board 20 and governing body shall: (1) establish by ordinance a system for issuing the multi-21 jurisdictional business license; and (2) integrate the application for the multi-22 jurisdictional business license with the state business portal. 23 – 2 – - *SB373_R1* THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. Chapter 244 of NRS is hereby amended by adding 1 thereto a new section to read as follows: 2 1. In a county whose population is 700,000 or more the board 3 of county commissioners shall adopt an ordinance for the 4 establishment of a multi-jurisdictional business license within the 5 county and each incorporated city located in the county, which 6 must, without limitation: 7 (a) Establish a system for issuing a multi-jurisdictional 8 business license for categories of businesses set forth in the 9 ordinance to engage in such business within the county; 10 (b) Include the requirements for obtaining the multi-11 jurisdictional business license; 12 (c) Include a revenue-sharing structure for participating 13 jurisdictions; and 14 (d) Include any other requirement necessary to establish the 15 system for issuing the multi-jurisdictional business license. 16 2. The board of county commissioners shall cooperate with 17 the governing body of each incorporated city in the county to enter 18 into an agreement in accordance with the provisions of NRS 19 277.080 to 277.180, inclusive, to establish a multi-jurisdictional 20 business license as agreed to by all the participating jurisdictions 21 for any specified category of business in accordance with the 22 ordinance adopted pursuant to subsection 1 or section 2 of this 23 act, as applicable. An agreement entered into pursuant to this 24 subsection must set forth the purposes, powers, rights, obligations 25 and responsibilities, financial and otherwise, of the county and 26 each incorporated city that enters into the agreement. 27 3. In entering into an agreement pursuant to subsection 2 to 28 establish a multi-jurisdictional business license for a specified 29 category of business, the board of county commissioners and 30 governing bodies shall consider whether the existing requirements 31 of the county or incorporated city for any business that falls within 32 the proposed category: 33 (a) Provide for the same or substantially similar fees for an 34 application for or an application to renew the existing license for 35 that business; 36 (b) Establish the same or substantially similar renewal periods 37 for the existing license for that business; and 38 (c) Regulate the business in the same or a substantially similar 39 manner with respect to any time, place or manner requirements. 40 4. Upon entering into an agreement pursuant to subsection 2 41 to create a multi-jurisdictional business license: 42 – 3 – - *SB373_R1* (a) The board of county commissioners shall establish by 1 ordinance a system for issuing such a multi-jurisdictional business 2 license that authorizes a person that operates a business in the 3 specified category of business to engage in that business within the 4 county and each incorporated city located in the county in which 5 the person intends to conduct business; 6 (b) The issuance of the multi-jurisdictional business license 7 must comply with the requirements of NRS 244.33506, 244.33507 8 and 244.33508; and 9 (c) The board of county commissioners and each governing 10 body of an incorporated city located in the county shall integrate 11 the application for the multi-jurisdictional business license with 12 the state business portal pursuant to paragraph (c) of subsection 3 13 of NRS 75A.100. 14 Sec. 2. Chapter 268 of NRS is hereby amended by adding 15 thereto a new section to read as follows: 16 1. Each governing body of an incorporated city in a county 17 whose population is 700,000 or more shall adopt an ordinance for 18 the establishment of a multi-jurisdictional business license within 19 the county and each incorporated city located in the county, which 20 must, without limitation: 21 (a) Establish a system for issuing a multi-jurisdictional 22 business license for categories of businesses set forth in the 23 ordinance to engage in such business within the county; 24 (b) Include the requirements for obtaining the multi-25 jurisdictional business license; 26 (c) Include a revenue-sharing structure for participating 27 jurisdictions; and 28 (d) Include any other requirement necessary to establish the 29 system for issuing the multi-jurisdictional business license. 30 2. Each governing body of an incorporated city shall 31 cooperate with each other governing body of an incorporated city 32 and board of county commissioners in the county to enter into an 33 agreement in accordance with the provisions of NRS 277.080 to 34 277.180, inclusive, to establish a multi-jurisdictional business 35 license as agreed to by all the participating jurisdictions for any 36 specified category of business in accordance with the ordinance 37 adopted pursuant to subsection 1 or section 1 of this act, as 38 applicable. An agreement entered into pursuant to this subsection 39 must set forth the purposes, powers, rights, obligations and 40 responsibilities, financial and otherwise, of the county and each 41 incorporated city that enters into the agreement. 42 3. In entering into an agreement pursuant to subsection 2 to 43 establish a multi-jurisdictional business license for a specified 44 category of business, the governing bodies and board of county 45 – 4 – - *SB373_R1* commissioners shall consider whether the existing requirements of 1 the incorporated city or county for any business that falls within 2 the proposed category: 3 (a) Provide for the same or substantially similar fees for an 4 application for or an application to renew the existing license for 5 that business; 6 (b) Establish the same or substantially similar renewal periods 7 for the existing license for that business; and 8 (c) Regulate the business in the same or a substantially similar 9 manner with respect to any time, place or manner requirements. 10 4. Upon entering into an agreement pursuant to subsection 2 11 to create a multi-jurisdictional business license: 12 (a) The governing body shall establish by ordinance a system 13 for issuing such a multi-jurisdictional business license that 14 authorizes a person that operates a business in the specified 15 category of business to engage in that business within the county 16 and each incorporated city located in the county in which the 17 person intends to conduct business; 18 (b) The issuance of the multi-jurisdictional business license 19 must comply with the requirements of NRS 266.358, 266.362 and 20 266.368; and 21 (c) The governing body and each other governing body of an 22 incorporated city located in the county and board of county 23 commissioners shall integrate the application for the multi-24 jurisdictional business license with the state business portal 25 pursuant to paragraph (c) of subsection 3 of NRS 75A.100. 26 H
