AN ACT relating to educational programs; revising provisions 
governing the award of grants by the State Board of 
Education for programs of career and technical education; 
eliminating certain reporting requirements for public 
schools that offer work-based learning programs; and 
providing other matters properly relating thereto. 
Legislative Counsel’s Digest: 
 Existing law requires the board of trustees of each school district in a county 1 
whose population is 100,000 or more (currently Clark and Washoe Counties), and 2 
authorizes the board of trustees of any other school district, to establish and 3 
maintain a program of career and technical education to provide instruction in 4 
subjects approved by the State Board of Education. (NRS 388.380) Existing law 5 
authorizes the Superintendent of Public Instruction and the State Board to award 6 
grants to school districts and charter schools for programs of career and technical 7 
education, including, without limitation, grants awarded based on criteria 8 
established by the State Board but limited in amount according to the proportional 9 
enrollment of pupils in programs of career and technical education in a school 10 
district or charter school. (NRS 388.392-388.395) Section 1 of this bill revises the 11 
calculation of the limit on the amount of this grant by providing that the limit is 12 
based on the proportion of pupils enrolled in advanced courses within a program of 13 
career and technical education rather than the proportion of all pupils enrolled in a 14 
program of career and technical education. 15 
 Existing law authorizes the board of trustees of a school district or the 16 
governing body of a charter school to offer a work-based learning program upon 17 
the approval of the Superintendent of Public Instruction. (NRS 389.167) Section 2 18 
of this bill eliminates the requirement for a school district or charter school that 19 
offers a work-based learning program to submit a report to the State Board and the 20

Legislature that contains certain information about the program, including the 21 
number of participating pupils, disaggregated based on certain characteristics. 22 
 
 
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN 
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: 
 
 Section 1.  NRS 388.395 is hereby amended to read as follows: 1 
 388.395 1.  The board of trustees of a school district or the 2 
governing body of a charter school may apply to the State Board of 3 
Education for a grant for a program of career and technical 4 
education, to be paid for from the remainder of state money 5 
described in subsection 3 of NRS 388.392. 6 
 2.  The State Board of Education shall review all applications 7 
submitted pursuant to subsection 1 and award grants based on the 8 
criteria established by regulation of the State Board of Education. 9 
 3.  The proportion of the total amount awarded pursuant to 10 
subsection 2 to a school district or charter school during a fiscal year 11 
must not exceed the proportion of the enrollment of pupils in 12 
advanced courses within programs of career and technical 13 
education in the school district or charter school during the previous 14 
fiscal year, as compared to the enrollments of pupils in advanced 15 
courses within programs of career and technical education 16 
throughout the State during the previous fiscal year. 17 
 4. As used in this section: 18 
 (a) “Advanced course” means: 19 
  (1) A CTE concentrator course; 20 
  (2) A work-based learning program pursuant to  21 
NRS 389.167; 22 
  (3) An activity for pupils to earn industry-recognized 23 
credentials, as identified by the Governor’s Office of Workforce 24 
Innovation pursuant to paragraph (d) of subsection 4 of  25 
NRS 232.975; 26 
  (4) A dual credit course in a program of career and 27 
technical education; or 28 
  (5) A course in a program of career and technical 29 
education that requires the completion of a CTE concentrator 30 
course as a prerequisite for enrollment. 31 
 (b) “CTE concentrator” has the meaning ascribed to it in 20 32 
U.S.C. § 2302(12). 33 
 (c) “CTE concentrator course” means a course within a 34 
program of career and technical education which may be used, in 35 
combination with another course, to meet the course requirements 36 
to be a CTE concentrator. 37

 Sec. 2.  NRS 389.167 is hereby amended to read as follows: 1 
 389.167 1.  A pupil enrolled at a public school must be 2 
allowed to apply one or more credits toward the total number of 3 
credits required for graduation from high school if the pupil 4 
successfully completes the number of hours in a work-based 5 
learning program required by regulation of the State Board to earn 6 
such credits. Any credits earned for successful completion of a 7 
work-based learning program must be applied toward the pupil’s 8 
elective course credits and not toward a course that is required for 9 
graduation from high school. 10 
 2.  The board of trustees of a school district or the governing 11 
body of a charter school may offer a work-based learning program 12 
upon application to and with the approval of the Superintendent of 13 
Public Instruction. An application to offer a work-based learning 14 
program must include, without limitation: 15 
 (a) The fields, trades or occupations in which a work-based 16 
learning program will be offered. 17 
 (b) The qualifications of a pupil to participate in the work-based 18 
learning program. Such qualifications must allow a majority of 19 
pupils to be eligible to participate in the work-based learning 20 
program. 21 
 (c) A description of the process that will be used by pupils to 22 
apply to participate in a work-based learning program. 23 
 (d) A description of the manner in which participation in a 24 
work-based learning program and completion of the requirements of 25 
a work-based learning program will be verified. 26 
 (e) A description of the manner in which the performance of a 27 
pupil who participates in the work-based learning program will be 28 
evaluated, which must include, without limitation, an on-site 29 
evaluation of the performance of the pupil. 30 
 3. Upon approval by the Superintendent of Public Instruction 31 
of an application to offer a work-based learning program submitted 32 
pursuant to subsection 2, the board of trustees or the governing body 33 
shall: 34 
 (a) Designate an employee of the school district or charter 35 
school, as applicable, to serve as a work-based learning coordinator 36 
to coordinate and oversee work-based learning programs. Such an 37 
employee must ensure that each business, agency or organization 38 
that will offer employment and supervision of a pupil as part of the 39 
work-based learning program is suitable for participation in a work-40 
based learning program. 41 
 (b) Establish and maintain a list of businesses, agencies and 42 
organizations that have been found suitable by the work-based 43 
learning coordinator pursuant to paragraph (a). 44

 4. To receive approval from the Superintendent of Public 1 
Instruction to offer a work-based learning program, the work-based 2 
learning program must include, without limitation, requirements 3 
that: 4 
 (a) A detailed training agreement and training plan be completed 5 
for each pupil participating in the work-based learning program for 6 
credit that identifies the specific tasks in which the pupil will 7 
participate that will develop competency of the pupil in the 8 
workplace; 9 
 (b) A pupil participating in the work-based learning program be 10 
allowed to leave the public school in which he or she is enrolled 11 
during the school day to participate in such a program; 12 
 (c) Participation by a pupil in the work-based learning program 13 
will develop a broad range of skills and will allow a pupil to focus 14 
on his or her chosen career pathway; and 15 
 (d) Training be completed by each pupil participating in the 16 
work-based learning program on: 17 
  (1) Identifying and reporting harassment in the workplace;  18 
  (2) Developing and maintaining healthy relationships in the 19 
workplace; and 20 
  (3) Identifying the signs of a person engaging in predatory 21 
conduct to prepare a pupil for sexual activity or to foster an 22 
inappropriate personal or professional relationship with a pupil, 23 
including, without limitation, through communicating or attempting 24 
to befriend or establish a relationship or other connection with a 25 
parent or legal guardian of a pupil in furtherance of such conduct. 26 
 5. A school district or charter school may allow a pupil who 27 
successfully completes a work-based learning program to earn dual 28 
credit for participation in the work-based learning program. 29 
 [6. On or before January 15 of each odd-numbered year, the 30 
board of trustees of a school district and the governing body of a 31 
charter school that offers a work-based learning program shall 32 
prepare a report concerning the manner in which the work-based 33 
learning program has been carried out and submit the report to the 34 
State Board and the Legislature. The report must include, without 35 
limitation: 36 
 (a) The number of pupils participating in the work-based 37 
learning program; and 38 
 (b) The types of work-based learning offered through the work-39 
based learning program. 40 
 7. The number of pupils participating in the work-based 41 
learning program reported pursuant to paragraph (a) of subsection 6 42 
must be disaggregated on the basis of the following characteristics: 43

 (a) Pupils who are American Indian or Alaska Native, Asian, 1 
Black or African American, Hispanic or Latino, Native Hawaiian or 2 
Pacific Islander, white or two or more races; 3 
 (b) Gender of pupils; 4 
 (c) Pupils who are migrants; and 5 
 (d) Pupils who are members of special populations, as defined in 6 
20 U.S.C. § 2302(48).] 7 
 Sec. 3.  This act becomes effective upon passage and approval. 8
