AN ACT relating to health insurance; revising the membership of 
the Board of Directors of the Silver State Health 
Insurance Exchange; and providing other matters properly 
relating thereto. 
Legislative Counsel’s Digest: 
 Existing law establishes the Silver State Health Insurance Exchange to facilitate 1 
the purchase of subsidized health plans by certain small employers and natural 2 
persons who are citizens of the United States or otherwise lawfully present in the 3 
United States. (Chapter 695I of NRS)  4 
 Existing law creates the Board of Directors of the Exchange which consists of: 5 
(1) five voting members appointed by the Governor; (2) one voting member 6 
appointed by the Majority Leader of the Senate; (3) one voting member appointed 7 
by the Speaker of the Assembly; and (4) three ex officio, nonvoting members. 8 
(NRS 695I.300) This bill requires that one member appointed by the Governor be a 9 
member of an Indian tribe located in this State with expertise in health care 10 
administration for an Indian tribe. 11 
 
 
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN 
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: 
 
 Section 1.  (Deleted by amendment.) 1

 Sec. 3.  NRS 695I.300 is hereby amended to read as follows: 1 
 695I.300 1.  The governing authority of the Exchange is the 2 
Board, consisting of seven voting members and three ex officio 3 
nonvoting members.  4 
 2.  Subject to the provisions of subsections 3 to 6, inclusive: 5 
 (a) The Governor shall appoint [five] : 6 
  (1) Four voting members of the Board [;] who have 7 
expertise in an area described in subsection 3; and  8 
  (2) One voting member of the Board who is a member of an 9 
Indian tribe which is located in this State who has expertise in 10 
health care administration for an Indian tribe. 11 
 (b) The Senate Majority Leader shall appoint one voting 12 
member of the Board; and 13 
 (c) The Speaker of the Assembly shall appoint one voting 14 
member of the Board. 15 
 3.  Each voting member of the Board must have: 16 
 (a) Expertise in the sale or marketing of individual or small 17 
employer health insurance; 18 
 (b) Expertise in health care administration, health care 19 
financing, health information technology or health insurance; 20 
 (c) Expertise in the administration of health care delivery 21 
systems; 22 
 (d) Experience as a consumer who would benefit from services 23 
provided by the Exchange; or 24 
 (e) Experience as a consumer advocate, including, without 25 
limitation, experience in consumer outreach and education for those 26 
who would benefit from services provided by the Exchange. 27 
 4.  When making an appointment pursuant to subsection 2, the 28 
Governor, the Majority Leader and the Speaker of the Assembly 29 
shall consider the collective expertise and experience of the voting 30 
members of the Board and shall attempt to make each appointment 31 
so that: 32 
 (a) The areas of expertise and experience described in 33 
subsection 3 are collectively represented by the voting members of 34 
the Board; and 35 
 (b) The voting members of the Board represent a range and 36 
diversity of skills, knowledge, experience and geographic and 37 
stakeholder perspectives.  38 
 5.  When making an appointment pursuant to subsection 2, the 39 
Governor, the Majority Leader and the Speaker of the Assembly 40 
shall, as vacancies on the Board occur, ensure that not more than 41 
two voting members of the Board represent any particular area of 42 
expertise or experience described in paragraph (a), (b), (c), (d) or (e) 43 
of subsection 3. The voting member described in subparagraph (2) 44 
of paragraph (a) of subsection 2 does not represent an area of 45

expertise or experience described in paragraph (a), (b), (c), (d) or 1 
(e) of subsection 3 for the purposes of this section. 2 
 6.  A voting member of the Board may not be a Legislator or 3 
hold any elective office in State Government. 4 
 7.  The following are ex officio nonvoting members of the 5 
Board who shall assist the voting members of the Board by 6 
providing advice and expertise: 7 
 (a) The Director of the Department of Health and Human 8 
Services, or his or her designee; 9 
 (b) The Director of the Department of Business and Industry, or 10 
his or her designee; and 11 
 (c) The Director of the Office of Finance, or his or her designee. 12 
 8. As used in this section, “Indian tribe” means a federally 13 
recognized American Indian tribe pursuant to 25 C.F.R. §§ 83.1 to 14 
83.12, inclusive. 15 
 Sec. 4.  (Deleted by amendment.) 16 
 Sec. 5. The Governor shall appoint the voting member of the 17 
Board of Directors of the Silver State Health Insurance Exchange 18 
described in subparagraph (2) of paragraph (a) of subsection 2 of 19 
NRS 695I.300, as amended by section 3 of this act, to replace the 20 
member appointed by the Governor whose term expires on June 30, 21 
2025. 22 
 Sec. 6.  1. This section and sections 4 and 5 of this act 23 
become effective upon passage and approval. 24 
 2. Section 3 of this act becomes effective on July 1, 2025. 25 
 3. Sections 1 and 2 of this act become effective: 26 
 (a) Upon passage and approval for the purpose of conducting the 27 
actuarial analysis required by paragraph (a) of subsection 2 of 28 
section 1 of this act, preparing and submitting the application for the 29 
federal waiver described in paragraph (b) of subsection 2 of section 30 
1 of this act and performing any other preparatory administrative 31 
tasks that are necessary to carry out the provisions of this act; and 32 
 (b) On January 1, 2028, for all other purposes. 33
