Establishes a system of merit selection of judges of the state's major trial courts instead of elections and for the designation of certain justices of the supreme court; affects certain courts including the supreme court, surrogate's court, the New York city civil court, the New York city criminal court and the district court.
Requires disclosure of possible conflicts; provides for the vacating of an arbitration award on the ground that the arbitrator was affiliated in any way with any party, or has a financial interest directly or indirectly in any party or in the outcome of the arbitration.
Repeals alternative notice provisions for certain proceedings to convey title to abandoned commercial and industrial real property to a city, town, or village.
Requires legislative approval for any change in the state agency or agency subdivision which has management and control, including but not limited to management and control over its maintenance and oversight, of any portion of the barge canal.
Amends the tenant dignity and safe housing act relating to special proceedings for judgment directing repairs of conditions and other relief in residential real property to limit jurisdiction; provides that proceedings may be maintained against any respondent with a legal obligation to maintain the property.
Enacts the "patient privacy protection act"; prohibits ex-parte interviews of other party's treating physicians or health care providers in personal injury, medical, dental, or podiatric malpractice, or wrongful death actions.
Clarifies and declares as the existing law of the state of New York the provisions of rules relating to the lapse of a power of withdrawal over the income or principal of a trust.
Prohibits pre-payment penalties for mortgages secured by real property owned in a cooperative form of ownership where over fifty percent of the units are shareholder occupied.
Relates to the composition of boards of elections; provides that such boards shall have other qualifications for performing their duties as the legislature may direct.
Provides representation to veterans that are at or below four hundred percent of the federal poverty guidelines for matters involving children, sustenance and real property proceedings.
Relates to audio-visual coverage of judicial proceedings; allows the judge or justice presiding over a proceeding to exercise discretion to prohibit or limit filming or photographing of particular participants; defines terms; provides limitations on audio-visual coverage.
