Extends confidentiality privileges to certain communications to or from a licensed mental health counselor in the course of his or her professional employment, and to certain employees of such licensed mental health counselor; provides exceptions thereto.
Enacts the "family court adjusted service time (FAST) act"; requires family courts in New York City to remain open until midnight on at least one weekday each week in at least two counties effective January 1, 2025, and in at least three counties, effective January 1, 2026.
Provides that after an alternate juror has been substituted, the jury shall deliberate anew on all issues submitted to the jury at the outset of deliberations; exempts issues for which a verdict was already rendered.
Relates to the tolling of statute of limitations for individuals in state custody; provides that with respect to state action brought by anyone to recover damages for physical, psychological, or other injury or condition suffered while in state custody, the time in which such action must commence shall be extended to three years after such person is released from such custody.
Relates to proceedings in family court; requires all transcripts of proceedings or hearings in family court shall be provided to the parties within five days of such proceeding or hearing; requires attorneys for children shall meet monthly with both parents or guardians and submit a report, including, but not limited to each meeting, the non-confidential, substantive portion of any meetings and any communications with the parties and the child or children; increases the compensation of assigned counsel from $158 to $200 and the total amount of reimbursement from $10,000 to $20,000; authorizes the right of a trial by jury for matters of fact in family court proceedings.
Relates to adding certain notice requirements for enforcing liens on goods in self-storage facilities; extends the demand for payment period to 60 days.
Enacts the "protection against unfair section 8 evictions (P.A.U.S.E.) act"; provides that in any case of public assistance where the municipality or section 8 refuses to pay the required portion of rent under any state, local or federal subsidy program due to building code violations or violations of the warranty of habitability pursuant to section two hundred thirty-five-b of the real property law, the tenant or lawful occupant of a dwelling shall not be required to pay his or her share under any state, local or federal subsidy program and shall not be subject to eviction summary proceedings for non-payment of rent or supplemental rent.
Excuses prospective jurors from jury service if they are a full-time caregiver responsible for the care of a person with a mental or physical condition that causes such person to be incapable of caring for himself or herself.
Requires town and village justices be admitted to practice law in New York state for at least five years as of the date they commence the duties of office.
Prohibits the enforcement of mandatory arbitration agreements clauses and joint-action waivers with respect to workplace disputes; clarifies that section 7515 of the civil practice laws and rules applies retroactively to nullify pre-existing illegal mandatory arbitration clauses.
