Establishes the crime of aggravated offering of a false accusation against a police officer or peace officer for knowing the information reported to be false or baseless, such person reports, by word or action, to a law enforcement officer or agency, the wrongdoing by a police officer or peace officer in the performance of such officer's duties; requires the posting of bail.
Includes aggravated cemetery desecration in the second degree and aggravated cemetery desecration in the first degree as specified offenses for purposes of hate crimes.
Enacts the "child survivor privacy act"; provides protections for child victims and child witnesses; restricts information to the public regarding a child witness or child victim's identity or proceeding; defines child witness; provides that whenever practical, the same prosecutor, advocate, and/or social worker shall handle all aspects of a case involving an alleged child victim.
Relates to offenses involving theft of identity; creates five tiers of crimes, based on the financial loss to the victim(s) and the number of people victimized.
Exempts from the use of self-defense sprays minors who are at least sixteen years of age and have been granted an order of protection or have been the victim of a crime, including where a criminal proceeding or investigation is still ongoing.
Adds a person having been previously convicted of petit larceny two times within any three month period or three times within any twelve month period to the definition of grand larceny in the fourth degree.
Removes ammunition and ammunition sales from the requirements of background checks; repeals certain provisions of law relating thereto; repeals the background check fund.
Includes within the class A misdemeanor of criminal possession of a weapon in the fourth degree, the possession of a firearm, rifle or shotgun, outside the home, while impaired or intoxicated by use of alcohol or drugs; increases maximum fine for such offense to $10,000; provides for chemical testing of certain persons for whom there is reasonable cause to believe are in violation of such provision; provides for revocation of firearms permit upon conviction or refusal of a chemical test.
Prohibits gun industry members from directing advertising, marketing, promoting, designing, or selling certain firearm-related products in a manner that would encourage unlawful purchase, possession, or use by underage individuals in the state; provides criteria for determining whether a gun industry member reasonably appears to support, recommend, or encourage underage individuals to unlawfully purchase a qualified product.
Adds impersonation of board of elections members or other election officers, or an employee thereof, to the crime of criminal impersonation in the first degree.
