Concerns the rescission of all previous requests by the New York State Legislature or either house thereof for a convention under Article V of the United States Constitution
Relates to the tolling of statute of limitations for individuals in state custody; provides that with respect to state action brought by anyone to recover damages for physical, psychological, or other injury or condition suffered while in state custody, the time in which such action must commence shall be extended to three years after such person is released from such custody.
Prohibits the enforcement of mandatory arbitration agreements clauses and joint-action waivers with respect to workplace disputes; clarifies that section 7515 of the civil practice laws and rules applies retroactively to nullify pre-existing illegal mandatory arbitration clauses.
Requires that plaintiffs no longer have to prove that a sexual offense occurred on the premises of, chattels or property belonging to a corporate entity in action for negligent supervision.
Makes a technical change to a provision requiring a petition in a summary proceeding to recover possession of real property in the city of Syracuse to allege proof of compliance with local laws requiring the registration or licensure of residential rental dwellings.
Provides for free legal representation in certain mortgage foreclosure actions where the homeowner is financially unable to obtain counsel; requires notice of such availability.
Establishes a housing court for actions and proceedings involving the enforcement of state and local laws for the establishment and maintenance of housing standards; requires such court to establish an escrow account; provides that any landlord that owns twenty units or less shall be entitled to free legal services if such landlord can prove a loss of at least twenty percent of rent payments in a calendar year; makes related provisions.
Requires any court which holds a special proceeding to recover real property to establish an escrow account where the tenant shall submit any owed rent into such account.
Relates to the "hope card act" to provide that any protected party of a final order of protection shall be provided either a digital image of the final order of protection as issued in court, delivered via text message, email or other electronic communication; or a durable, wallet-sized physical card that contains a summary of information about a final order of protection; makes related provisions.
Provides that any landlord that is in mortgage foreclosure due to loss of rent payments cannot enter into a state of foreclosure until a court handling a special proceeding to recover rent resolves any rent issues.
Establishes venue in actions to recover student debt; provides that in actions to recover student debt owed to the state of New York, the place of trial shall be the residence of the defendant, if one resides in the state.
