Enacts the "Lieutenant Joseph Banish mental health act" to provide a testimonial privilege for communications arising out of law enforcement peer support counseling.
Provides that no person shall be denied equal rights under the laws of this state or any subdivision thereof based on that person's sexual orientation or actual or perceived gender identity, appearance, behavior, expression, or other gender-related characteristic regardless of the sex assigned to that person at birth, including, but not limited to, the status of being transgender.
Standardizes the language across the relevant court acts to allow tenants statewide to sue in the county where the real property at issue is located in matters relating to a tenancy or lease; requires the Office of Court Administration to develop necessary forms, procedures and deliver a report.
Requires the chief administrator of the courts to provide reports on legal training programs conducted by the office of court administration, the performance of the judges and justices of the unified court system, and the security of the judicial and non-judicial officers of the unified court system.
Establishes procedures regarding orders of post-termination visitation and/or contact between a child and such child's parent and for modification of such orders.
Provides that in order to present the claim for unjust conviction and imprisonment, claimant must establish by documentary evidence that: he or she has been convicted of one or more felonies or misdemeanors against the state and subsequently sentenced to a term of imprisonment, and has served all or any part of the sentence; and he or she has had the one or more felonies and misdemeanors dismissed with prejudice following serving all or part of the sentence; and his or her claim is not time-barred.
Requires town and village justices be admitted to the practice of law in this state and reside in the municipality in which the position is located; provides an exception to the requirement for currently serving justices; provides for the office of court administration to grant a waiver of the requirements.
Provides that any small property owner that owns twenty units or less shall be entitled to free legal services if such small property owner can prove a loss of at least twenty percent of rent payments in a calendar year; defines "small property owner" as any lessor in a residential real property transaction, and includes an owner of twenty units or less who lists residential real property for lease with an agent, whether or not a lease results, or who receives an offer to lease twenty units of residential real property or less.
Extends the statute of limitations to bring a claim arising out of an alleged sexual offense by a law enforcement officer if the alleged offense occurred while the officer was employed by a law enforcement agency.
Amends provisions of law governing arbitration proceedings; specifies fees and expenses with regard to employment or consumer arbitration proceedings; directs certain sanctions on a party which breaches an arbitration agreement.
Provides that the court shall confirm an award in a public sector arbitration proceeding upon application of a party made within one year after delivery to the party, unless an application to vacate or modify the award upon certain grounds is made.
