Relates to gun buy back programs; requires entities operating such programs to check the serial number of all firearms obtained against the NYSPIN records and to obtain the express permission of the lawful owner of any firearm found to be stolen before the destruction thereof.
Establishes the crimes of criminal trespass on a school bus, school grounds or children's camp; requires the commissioner of motor vehicles, in consultation with the commissioner of transportation, to promulgate rules and regulations for certain signage on school buses; relates to professional development school bus driver safety training seminars statewide.
Exempts from the use of self-defense sprays minors who are at least sixteen years of age and have been granted an order of protection or have been the victim of a crime, including where a criminal proceeding or investigation is still ongoing.
Relates to certifying instructors in small arms practice; provides that after December 31, 2026 individuals certified as an instructor in small arms practice shall seek recertification subject to the standards and curriculum promulgated by the division of criminal justice services.
Requires the court to make an individualized determination whether a defendant poses a current physical threat to any person or to public safety when making a bail determination.
Authorizes the transfer of certain weapons from an estate to an immediate member of the decedent's family; expands definition of immediate family to include siblings, grandparents and grandchildren as such term relates to the sale or disposal of certain firearms; relates to the filing of approved applications for licenses for the possession of firearms; exempts certain large capacity ammunition feeding devices from certain requirements of the penal law; repeals provisions of law prohibiting the possession of certain large capacity ammunition feeding devices; repeals provisions relating to certain requirements for the sellers of ammunition.
Provides that crimes committed against a person on school grounds shall be deemed to be one category higher than the specified crime the person committed; enacts "Suzanne's Law".
Creates a private right of action for fertility fraud; adds a health care practitioner using human reproductive material from the practitioner or from a donor knowing or who reasonably should have known that such patient had not expressly consented to such use, to the crime of aggravated sexual abuse in the fourth degree; relates to the time in which to commence actions relating to fertility fraud; includes fertility fraud in the definition of professional misconduct for physicians, physician's assistants and specialist assistants.
Relates to the regulation of three-dimensional printed firearms; provides that a person who intentionally sells, distributes, or disposes of a three-dimensional printed firearm is guilty of a class A misdemeanor.
Limits the circumstances which justify the use of deadly force by a police officer or peace officer to instances when the person committed a felony that threatened or resulted in death or serious bodily injury and the officer reasonably believes that the person will cause death or serious bodily injury to another person unless immediately apprehended.
