Provides for the filling of vacancies in the office of lieutenant-governor by appointment of the governor subject to confirmation by majority vote in the senate and majority vote in the assembly; provides for an extended order of succession for the filling of a vacancy in the office of the governor.
Relates to the scheduling of a fact finding hearing after the issuance of a temporary order of protection in family court; provides that such hearing shall be scheduled no later than 14 days after the temporary order is issued.
Prohibits self-service facility owners from enforcing liens, by private or public sale, on personal property held in a self-storage facility during state disaster emergencies or county states of emergency.
Relates to the proper form of exhibits for submission; provides every exhibit shall be clearly identified, but no specific method of labeling shall be required.
Relates to persons who may become a voluntary administrator; includes fiduciaries of a deceased distributee, or a competent adult who is not a distributee upon the filed consent of all competent distributees as persons who can become a voluntary administrator prior to the chief fiscal officer of the county becoming such.
Requires judges or justices in a court that exercises criminal jurisdiction, including town and village justices, family court judges, and justices of the supreme court who regularly handle matrimonial matters, and court clerks of such courts to attend a program approved by the chief administrator of the courts addressing issues relating to domestic violence totaling at least ten hours every two years; requires law enforcement officers to complete ten hours of domestic violence training every two years.
Allows tenants to appeal judgments or orders issued against them without first being required to pay any portion of such judgment or order; postpones such payment until the end of the stay triggered by service upon the landlord of the notice of appeal or affidavit of intention to move for permission to appeal such judgment or order or pay an undertaking.
Requires the state commission on judicial conduct to transmit its annual budget request to the governor for inclusion in the executive budget without revision; relates to complaints regarding judges and confidentiality of records; extends the jurisdiction of the state commission on judicial conduct as to judges who resign or retire while under investigation or formal charges.
Authorizes the chief administrator of the courts to require and provide at least three hours of annual training regarding bail, recognizance, and commitment procedures and standards for all judges exercising preliminary jurisdiction over any offense.
Extends certain provisions relating to authorizing New York city marshals to exercise the same functions, powers and duties as sheriffs with respect to the execution of money judgments of the supreme and family courts of the city of New York; requires New York city marshals to post and electronically file notices of eviction.
Extends confidentiality privileges to certain communications to or from a licensed mental health counselor in the course of his or her professional employment, and to certain employees of such licensed mental health counselor; provides exceptions thereto.
