Relates to fees charged for the issuance of number plates and to requiring a report on the costs of manufacturing such plates; requires the fee for a number plate not to exceed the cost of producing such plate; establishes that no additional fee shall be charged to keep a current number plate due to a design change implemented by the commissioner; requires the commissioner of the department of corrections and community supervision to report on the costs of manufacturing license plates.
Includes within the provisions of the class D felony of assault in the second degree, the reckless causation of serious physical injury to a child under seven years of age, by a person eighteen years of age or older; provides that "serious physical injury", for the purposes of the penal law, shall include, in the case of a child under 7 years of age, subdural hemorrhage, intercranial hemorrhage and retinal hemorrhages.
Prohibits wagers on a horse racing event unless such racing event is offered pursuant to a fixed odds sports wagering agreement; authorizes agreements between a mobile sports wagering operator and an affiliate to locate self-service sports betting kiosks upon the premises of the affiliate.
Provides that a person is guilty of loitering when such person remains in a transportation facility, within twenty-five feet of the token booth or similar location, for more than twenty-five minutes unless authorized to do so or unless the facility's design would make it impossible to maintain a greater distance.
Provides that for members of a public pension or retirement system, accrued benefits shall not be diminished or impaired except as authorized and prescribed by the legislature.
Mandates a fixed percentage of annual harness horse breeders awards; requires that all sire stakes funds generated by a specific racetrack be returned as purses to such track at the same level in order to allow New York to compete with states that have stronger awards programs.
Extends the provisions relating to the New York state thoroughbred breeding and development fund until twelve years after the commencement of the operation of a video lottery terminal facility at Aqueduct racetrack.
Requires unanimous agreement between management, the gaming commission and the horsemen's association representative before race days can be cancelled, as well as language requiring cancelled race days to be made up.
Provides that a false representation of affiliation or approval, or false implication of such affiliation or approval, of any official, state or local agencies or other official source, shall be false advertising.
Increases the penalties for sexual performances by a child; increases age from 16 to 18 for application of existing sexual performance crimes; creates crimes of use of a child in a sexual performance in the first degree, promoting an obscene sexual performance by a child in the first degree, and promoting a sexual performance by a child in the first degree; provides for consecutive sentencing upon certain multiple convictions.
