An Act relating to ag riculture; amending 2 O.S. 2021, 
Section 2-4c, which relates to the power to regulate 
care and handling of livesto ck, partial preemption of 
local orders, ordinances, or r egulations; providing 
that standards for erection, installation, and use of 
structures and equipment for agricultur al purposes 
are regulated by the Oklahoma Department of 
Agriculture, Food, and Forest ry; and providing an 
effective date. 
 
 
 
 
 
AMENDMENT NO. 1. Page 1, strike the title, enacting clause and 
entire bill and insert 
 
“An Act relating to ag riculture; amending 2 O. S. 
2021, Section 2-4c, which relates to the power to 
regulate care and handling o f livestock, partial 
preemption of local orders, ordinances, or 
regulations; providing that stand ards for erection, 
installation, and use of structures and equipment for 
the care and handling of livestock and planting of 
agricultural crops are regulated by the Oklahoma 
Department of Agriculture, Food, and Forestry ; 
providing for certain application ; and providing an 
effective date. 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

SECTION 1.    AMENDATORY    2 O.S. 2021, Section 2-4c, is 
amended to read as foll ows: 
Section 2-4c. A.  Except as may otherwise be provided by law, 
the Oklahoma Department of Agriculture, Food, and Forestry shall be 
the state entity empowered to implement the policy of the state 
regarding the care and h andling of livestock in this sta te. 
B.  No municipality, county, or other political subdivision of 
this state shall enact or enforce any order, ordinance, or 
regulation concerning the care and handling of livestock wit hin its 
jurisdiction that is more rest rictive than rules promulgated b y the 
Oklahoma Department of Agriculture, Food, and Forestry concerning 
the care and handling of livestock or Section 1685 of Title 21 of 
the Oklahoma Statutes.  Ordinances or regulation s by municipalities 
pertaining to land use or to human health or safet y shall not be 
considered to constitute livestock care and handling. 
C.  Except as otherwise provided by law as of the effective date 
of this act, standards for erection, installation, a nd use of 
structures and equipment use d for care and handling of livestock , 
poultry facilities, and planting of agricultural crops, except 
medical marijuana, shall only be subject to regula tion by the 
Oklahoma Department of Agriculture, Fo od, and Forestry.  This 
subsection shall only apply to all entities who purport to regulate 
the erection, installation, and use of structures and equipment f or 
care and handling of livestock, poultry, and planting of

agricultural crops, except medical marijuana , in unincorporated 
areas. 
SECTION 2.  This act shall become effective November 1, 2022.”

SECTION 3.     AMENDATORY    2 O.S. 2021, Section 2 -4c, is 
amended to read as foll ows: 
Section 2-4c. A.  Except as may otherwise be provided by law, 
the Oklahoma Department of Agriculture, Food, and Forestry shall be 
the state entity empowered to implement the policy of the sta te 
regarding the care and handling of livestock in this sta te. 
B.  No municipality, county, or other political subdivision of

regulation concerning the care and handling of livestock within its 
jurisdiction that is more restrictive than rules promulgated b y the

Oklahoma Department of Agriculture, Food, and Forestry concerning 
the care and handling of livestock or Section 1685 of Title 21 of 
the Oklahoma Statutes.  Ordinances or regulations by munici palities 
pertaining to land use or to human health or safet y shall not be

C. Except as otherwise provided by law as of the effective date 
of this act, standards for erection, installation, and u se of 
structures and equipment used for agricultural purpos es, including 
livestock or poultry facilities and the planting of agricultural 
crops, except medical marijuana, shall only be subject to regulati on 
by the Oklahoma Department of Agriculture, Food, and Forestr y.  This 
section shall apply to all unincorporated property , the State Fire 
Marshal, and other entities who purport to regulat e the erection, 
installation, and use of structures and equipment f or agricultural 
purposes. 
SECTION 4.  This act shall become effective November 1, 2022.
