AS INTRODUCED 
 
An Act relating to state government; prohibiting 
state governmental entities organized within the 
executive branch of state government from requiring 
certain evidence related to surgical procedures; 
providing for codification; providing an effective 
date; and declaring an emergency . 
 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 9501 of Title 74, unless there 
is created a duplication in numbering, reads as follows: 
No agency, board, commission, department, instrumentality o r 
other entity organized within the executive branch of state 
government shall require, if applicable, on any form or other 
document used by the state governmental entity as part of a process 
for changing gender identification on a driver licen se or any permit 
or other form of identification used by such entity an affidavit, 
attesting to the applicant’s gender identity.  The applicant’s 
affidavit shall be accepted as conclusive proof of gender change if

it contains substantially the following language:  "I, [name of 
applicant], hereby attest under penalty of perjury that the request 
for a change in gender to (female, male or nonbinary) is to conform 
my legal gender to my gender identity and is not for any fraudulent 
purpose." 
SECTION 2.  This act shall become effective July 1, 2021. 
SECTION 3.  It being immediately necessary for the preservation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reason whereof this act shall take effect and 
be in full force from and after its pass age and approval.
