HOUSE BILL 2109 	By: Turner 
 
 
 
 
 
AS INTRODUCED 
 
An Act relating to state government; requiring state 
governmental entities organized within the executive 
branch of state government to i nclude certain choices 
regarding natural persons in documents; providing 
exception; providing for codification; providing an 
effective date; and declaring an emergency . 
 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 9501 of Title 74, unless there 
is created a duplication in numbering, reads as follows: 
Each agency, board, commission, department, instrumentality o r 
other entity organized within the executive branch of state 
government shall include, if applicable, on any form or other 
document used by the state governmental entity as part of a process 
for determining a natural person 's identity a nonbinary option 
wherever options for male and female exist . The provisions of this 
section shall not be applicable to any form or document used by the

state governmental entity if gender information is not required or 
is not otherwise part of the content of the form or document. 
SECTION 2.  This act shall become effective July 1, 2021. 
SECTION 3.  It being immediately necessary for the preservation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reason whereof this ac t shall take effect and 
be in full force from and after its passage and approval.
