BILL NO. 2402 By: Russ, Wallace and Moore of

Jech of the Senate
An Act relating to public buildings and public works;
defining term; authorizing design -build for public
water supply and wastewater treatment; re quiring
certain permit process; authorizing pilot programs;
providing for codification; providing an effective
date; and declaring an emergency .
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new sect ion of law to be codified
in the Oklahoma Statutes as Section 220.1 of Title 61, unless there
is created a duplication in numbering, reads as follows:
A. For purposes of this section , "design-build" means a project
delivery method in which one entity work s under a single contract
with the project owner to provide design and construction services.
B. A conservancy district formed pursuant to Section 541 of
Title 82 of the Oklahoma Statutes, a municipality, a county, a
public trust, and any other political subdivision in this state that
operates a public water supply system or wastewater treatment or

collection system is authorized to utilize design -build as a project
delivery method for public water supply and wastewater treatment
facilities and wastewater collection systems.
C. No later than November 1, 2022, the Oklahoma Department of
Environmental Quality shall incorporate into its administrative
rules a flexible permitting process to allow the utilizati on by the
entities identified in subsection B of this section of the design-
build project delivery method for public water supply and wastewater
treatment facilities and wastewater collection systems.
D. In the interim between the effective date of this a ct and
promulgation of rules, the Department may au thorize no more than
five pilot projects in which the entities identified in subsection B
of this section may utilize the design -build project delivery method
for public water supply and wastewater treatme nt facilities and
wastewater collection systems, an d the Department may use the
results to promulgate rules.
SECTION 2. This act shall become effective July 1, 2021.
SECTION 3. It being immediately necessary for the preser vation
of the public peace, health or safety, an em ergency is hereby
declared to exist, by reason whereof this act shall take effect and
be in full force from and after its passage and approval.
