An Act relating to the Department of Human Services; 
limiting applications for certain home - and 
community-based services; requiring the promulgation 
of rules; providing for codification; providing an 
effective date; and declaring an emergency. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codifi ed 
in the Oklahoma Statutes as Section 2005 of Title 56, unless there 
is created a duplication in numbering, reads as follows: 
Applications for Home and Community Based Medicaid Waiver 
Services for the Community Waiver, In -Home Supports Waiver for 
Adults, and In-Home Supports Waiver for Children operated by the 
Department of Human Services shall not be made until an applicant 
has been a resident of Oklahoma for five (5) years prior to the date 
of application.  The Department of Human Services shall promulga te 
rules as necessary for the implementation and administration of the 
provisions of this section.

SECTION 2.  This act shall become effective July 1, 2021. 
SECTION 3.  It being immediately necessary for the preservation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reason whereof this act shall take effect and 
be in full force from and after its passage and approval.
