HOUSE BILL 3222 	By: Roberts (Dustin) 
 
 
 
 
 
AS INTRODUCED 
 
An Act relating to contracts; prohibiting 
uncontracted third-party pick-up and delivery of 
food; authorizing restaurants to ter minate contracts; 
creating fine for violation; creating right of 
action; and providing an effective date. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 581 of Title 15, unless there is 
created a duplicatio n in numbering, reads as follows: 
A.  A food delivery platform shall not offer pick -up or delivery 
services from a restaurant without first obtaining an agreement with 
the restaurant expressly authorizing the food delivery platform to 
take orders and offer delivery or pick-up of the food and/or 
beverages prepared by the restaurant. 
B.  The agreement shall be terminated upon the restaurant 's 
written request to the food de livery platform.  The food delivery 
platform shall remove the restaurant from its list o f participating

restaurants within seventy two (72) hours of receiving the request 
for termination. 
SECTION 2.     NEW LAW     A new section of law to be co dified 
in the Oklahoma Statutes as Section 582 of Title 15, unless there is 
created a duplication in numbering, reads as follows: 
A.  Platforms that violate this act shall be fined Two Hundred 
Fifty Dollars ($250.00) plus statutory assessments , and shall be 
fined an additional Two Hundred Fifty Dollars ($250.00) for each day 
of noncompliance. 
B.  Any person or class of persons that suffers injury as a 
result of a violation of this act may bring a civil action in a 
court of competent jurisdiction agains t the person violating this 
act and, upon prevailing, may be awarded reasonable at torney fees 
and costs and such legal or equitable relief as may be appropriate 
to remedy the violation. 
SECTION 3.  This act shall become effective November 1, 2022.
