BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: SECTION 1. AMENDATORY 59 O.S. 2021, Section 521.3, is amended to read as follows: Section 521.3 A. A physician assistant licensed in this state or licensed or authorized to practice in any other U.S. jurisdict ion or who is credentialed as a physician assistant by a federal employer who is responding to a need for medical care created by an HB3223 HFLR Page 2 BOLD FACE denotes Committee Amendments. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 emergency or a state or local disaster may render such care that the physician assistant is able to provide. B. A physician assistant so responding who voluntarily and gratuitously, and other than in the ordinary course of employment or practice, renders emergency medical as sistance shall not be liable for civil damages for any personal injuries that result from acts or omissions which may constitute ord inary negligence. The immu nity granted by this section shall not apply to acts or om issions constituting gross, willful or wanton negligence. C. Nothing in the Physician Assistant Act shall limit the activities of a physician assistant in the perform ance of their duties if the physician assistant is employed by or under cont ract with the United States Department of Veterans A ffairs or if the physician assistant is employed by, under contract with, or commissioned by one of the uniformed services; prov ided, the physician assistant m ust be currently licensed in this state or an y other state or currently credentialed as a physici an assistant by the United States Department of Veterans Affairs or the applicable uniformed service. As used in this subs ection, "uniformed services" shall have the same meaning as provided by Title 10 of the U nited States Code. SECTION 2. This act shall become ef fective November 1, 2022.
