AS INTRODUCED 
 
An Act relating to elections; providing for 
suspension of provisions implementing federal law; 
providing for certain determinat ion; providing for 
notification and publication ; authorizing 
promulgation of rules; authorizing modification of 
certain voting procedures; providing for 
codification; and providing an effective date . 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW    A new section of law to be codified 
in the Oklahoma Statutes as Section 22-117 of Title 26, unless there 
is created a duplication in numbering, reads as follows: 
A.  In the event any federal law, regulat ion, order, or other 
official action seeks to substantially modify or super sede any voter 
registration or election administration laws and procedures duly 
enacted by the Legislature, that federal law, regulation , order, or 
other official action shall be ap plicable only to elections for 
federal office held in this state.

B.  Notwithstanding any federal law, regulation, order, or other 
official action, the voter registration or election administration 
laws and procedures duly enacted by the Legislature shall continue 
to be enforced for all state, county, municipal, and other poli tical 
subdivision elections held in this state. 
C.  The determination that a federal law, regulation, order, or 
other official action would su bstantially modify or supersede the 
voter registration or election administration laws and procedures 
duly enacted by the Legislature shall be made by the Attorney 
General, with the concurrence of the Secretary of the State Election 
Board. The determination shall be made in writing and shall state 
the reasons for the determination. 
D.  1.  In the event that such determination is made, no other 
election authorized by state law shall be conducted on the same date 
as a regular or special election for fede ral office.  
2. The Secretary of the State Elec tion Board shall temporarily 
modify such election dates and other associated dates and deadlines 
provided in Title 26 of the Oklahoma Statutes to ensure that no 
other election in this state is held on the same date as a special 
or regular election for fede ral office.  The modification of 
election dates and other associated dates and deadlines shall remain 
in effect until the Legislature shall repeal it or shall enact 
modified election dates and other associated dates and deadlines by 
law.

3.  The Secretary of the State Election Board shall notify the 
Governor, the Presid ent Pro Tempore of the Oklahoma State Senate, 
and the Speaker of the Oklahoma House of Representatives in writing 
about such modifications and shall publish the sam e on the website 
for the State Election Board. 
4.  Persons who register to vote pursuant to federal law, 
regulation, order, or other official action shall be eligible to 
vote only in elections for federal office if the voter registration 
was submitted or otherwise made in a ma nner not authorized by the 
laws or procedures duly enacted by the Legislature. 
E.  The Secretary of the State Election Board may promulgate 
such rules and procedures necessary to implement the provisions of 
this section. 
SECTION 2.  This act shall become effective November 1, 2022.
