AS INTRODUCED 
 
An Act relating to motor vehicles; amending 47 O.S. 
2021, Section 1-186, which relates to vehicles; 
modifying definition; amending 47 O.S. 2021, Section 
4-107, which relates to removed, falsified, or 
unauthorized identification ; penalizing certain 
removal or falsification of trailer identification 
numbers; modifying definition; and providing an 
effective date. 
 
 
 
 
SECTION 1.     AMENDATORY     47 O.S. 2021, Section 1 -186, is 
amended to read as follows: 
Section 1-186. Vehicle. 
A.  A vehicle is any device in, upon or by which any person or 
property is or may be transport ed or drawn upon a highway, including 
trailers, and excepting devices used exc lusively upon stationary 
rails or tracks. 
B.  As used in this title, the term "vehicle" shall not include: 
1.  Implements of husbandry, as defined in Section 1 -125 of this 
title; 
2.  Electric personal assistive mobility devices , as defined in 
Section 1-114A of this title; or

3.  Motorized wheelchairs, as defined in Section 1-136.3 of this 
title. 
SECTION 2.     AMENDATORY     47 O.S. 2021, Section 4 -107, is 
amended to read as follows: 
Section 4-107. (a)  Any person or persons who shall des troy, 
remove, cover, alter or deface, or cause to be destroyed, removed, 
covered, altered or defaced, the engine number or other 
distinguishing number o f any vehicle in this state, without first 
giving notice of such act to the Oklahoma Tax Commission, upo n such 
form as the Commission may prescribe, or any person who shall give a 
wrong description in any application for the registration of any 
vehicle in this state for the purpose of concealing or hiding the 
identity of such veh icle, shall be deemed guilty of a felony and 
upon conviction thereof shall be punished by imprisonment in the 
State Penitentiary for a term of not less than one (1) year nor more 
than five (5) years. 
(b)  A person who buys, receives, possesses, sells or di sposes 
of a vehicle or an eng ine for a vehicle, knowing that the 
identification number of the vehicle or engine has been removed or 
falsified, shall, upon conviction, be guilty of a misdemeanor. 
(c)  A person who buys, receives, possesses, sells or dispose s 
of a trailer, vehicle or an engine for a vehicle, with knowledge 
that the identification number of the trailer, vehicle or engine has 
been removed or falsified and with intent to conceal or misrepresent

the identity of the trailer, vehicle or engine, sha ll, upon 
conviction, be guilt y of a felony. 
(d)  A person who removes a license plate from a vehicle or 
affixes to a vehicle a license plate not authorized by law for use 
on said vehicle with intent to conceal or misrepresent the identity 
of the vehicle or its owner shall, upon convic tion, be guilty of a 
misdemeanor. 
(e)  As used in this section: 
1.  "Identification number " includes an identifying number, 
serial number, engine number or othe r distinguishing number or mark, 
placed on a trailer, vehicle or engine by its manufacturer or b y 
authority of the Oklahoma Tax Commission or in accordance with the 
laws of another state or country; 
2.  "Remove" includes deface, cover and destroy; 
3.  "Falsify" includes alter and for ge. 
(f)  An identification number may b e placed on a vehicle or 
engine by its manufacturer in the regular course of business or 
placed or restored on a vehicle or engine by authority of the 
Oklahoma Tax Commission without violat ing this section; an 
identification number so placed or restored is not falsified. 
SECTION 3.  This act shall become effective November 1, 2022.
