An Act relating to State Capitol building; providing 
for the Office of Management and Enterprise Services 
to promulgate rules for a flag flying program; 
providing for request to fly flag over State Capitol; 
authorizing OMES to develop fee st ructure; depositing 
of certain fee to certain fund; providing for flags 
allowed to be flown; providing for codification; 
providing an effective date; and declaring an 
emergency. 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 27 of Title 73, unless there is 
created a duplication in numbering, reads as foll ows: 
A.  The Office of Management and Enterprise Services (OMES) 
shall promulgate rules for a flag flying program enabling the people 
of Oklahoma to request for a flag or flags to be flown at the 
Oklahoma State Capitol building on specific days for commemo rative 
purposes.  Such flags shall be flown at the State Capitol based on 
availability and in conformity with the rules established by OMES on 
a first-come, first-served basis; provided, that the person 
requesting the flag completes all necessary forms and pays all

necessary fees required by OMES for the implementation of this 
section of law. 
B.  OMES is hereby authorized to develop a fee structure to 
provide for the costs associated with the flag fl ying program 
including but not limited to the cost of the purchase of the flag, 
cost of employee service s and cost of certificate confi rming date 
and time flag was flown.  An additional fee of Twenty-five dollars 
($25.00) per flag flown shall be charged an d deposited into the 
Capitol Preservation Fund. 
C.  The flags available to be flown over the Oklahoma State 
Capitol according to this s ection shall be: 
1.  The current flag of the State of Oklahoma ; 
2.  The current flag of the United States; 
3.  The original (Star & 46) flag of the State of Oklahoma ; 
4.  The original 13 Stars and Stripes flag of the United States 
also known as the Betsy R oss flag; 
5.  The “An Appeal to Heaven” flag flown by General George 
Washington; 
6. The Gadsden flag also known as th e “Don’t Tread On Me” flag; 
7.  The POW/MIA flag; 
8.  The National Guard flag; and 
9.  Any official flag for any branch of the United State s Armed 
Forces. 
SECTION 2.  This act shall become effective July 1, 202 2.

SECTION 3.  It being immediately necessary for the preservation 
of the public peace, health or safety, an emergen cy is hereby 
declared to exist, by reason whereof this act shall take effect and 
be in full force from and after its passage and approval.
