SENATE BILL NO. 1207 	By: Montgomery 
 
 
 
 
 
An Act relating to student assessments; a mending 70 
O.S. 2021, Section 1210.508 -2, which relates to 
limited exemptions from man dated tests; directing the 
State Board of Education to promulgate rules 
providing limited exceptions for mandated tests to be 
administered to certain students outside of certain 
window; providing an effective date; and declaring an 
emergency. 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     AMENDATORY     70 O.S. 2021, Section 1210.508 -2, 
is amended to read as follows: 
Section 1210.508-2. A. The State Board of E ducation shall 
promulgate rules providing for limited exemptions from the mandated 
tests administered pursuant to the provisions of the Oklahoma School 
Testing Program Act for stude nts facing exceptional emergency 
circumstances which prevent the student fr om being assessed during 
the testing window.  For purposes of this section, exceptio nal 
emergency circumstance shall be defined to include situations 
involving serious accidents or medical emergency events involving 
the student, a parent or guardian of the student or a sibling of the 
student.

B.  The State Board of Education shall promulg ate rules 
providing for limited exceptions for tests mandated by the Oklahoma 
School Testing Program Act to be administered outside of the testing 
window. The limited exceptions shall provide for mandated tests to 
be administered outside of the testing window to: 
1.  A student whose school site within the same school district 
changes or whose resident school district changes due to placement 
by an agency having legal custody of the child pursuant to a court 
order or by a state agency having legal custody o f the child 
pursuant to the provisions of Title 10A of the O klahoma Statutes; 
and 
2.  A student who has been classified as homeless according to 
the federal definition set forth in 42 U.S.C., Sec tion 11434a. 
SECTION 2.  This act shall becom e effective July 1, 2022. 
SECTION 3.  It being immediately necessary for the preservation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reaso n whereof this act shall take effect a nd 
be in full force fro m and after its passage and approval.
