An Act relating to school employees; directing each 
school district board of education to adopt certain 
policy for school district employees who are 
lactating; requiring each school district to make a 
reasonable effort to provide ce rtain room or other 
location for an employee to express milk or 
breastfeed a child; providing for codification; 
providing an effective date; and declaring an 
emergency. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.    NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 5 -149.3 of Title 70, unless 
there is created a duplication in numbering, reads as follows: 
A.  Each school district board of education in this state shall 
adopt a policy allowing a school district employee who is lactating 
reasonable paid break time each day to use a designated lactation

room for the purpose of maintaining milk supply and comfort.  The 
break time may run concurrently with any break time, paid or unpaid, 
already provided to the employee. 
B.  Each school district board of education shall make a 
reasonable effort to provide a private, secure and sanitary room or 
other location, other than a toilet stall, where an employee can 
express her milk or breastfeed he r child. 
SECTION 2.  This act shall become effective July 1, 2021. 
SECTION 3.  It being immediately necessary for the preservation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reason wh ereof this act shall take effect and 
be in full force from and after its passage and approval.
