BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKL AHOMA: SECTION 1. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 6060.11a of Title 36, unless there is created a duplication in numb ering, reads as follows: A. As used in this section: 1. “Market conduct examination” means an examination of the health insurance operations of any entity administering a health benefit plan in this state as defined pursuant to subsection C of Section 6060.4 of Title 36 of the Oklahoma statutes; and 2. “Mental health parity” means the equal treatment of mental health conditions and substance use disorder s in a health benefit Req. B. The Insurance Department is hereby directed to conduct a market conduct examination to analyze the non-quantitative limitations of mental health parity. The study shall include an assessment of network adequac y for the purposes of reporting the availability of in-network mental health providers. The Department shall use annual reports provided to the Department pursuant to subsection E of Section 6060.11 of Title 36 of the Oklahoma Statutes. C. The Department shall furnish the examination findings to the President Pro Tempore of the Senate, the Speaker of the House of Representatives, and the Governor, and publish the examination findings on the Mental Health Parity page of the Department website no later than July 1, 2023.
