BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: SECTION 1. AMENDATORY 70 O.S. 2021, Section 5 -106, is amended to read as follows: Section 5-106. A. The governing board of each school district in Oklahoma is hereby designated and shall hereaft er be known as the board of education of such dist rict. Except as otherwise provided in this section, the sup erintendent of schools appointed and employed by the board shall be the executive officer of the board and shall perform duties as the board directs. B. The board may contract with a superintende nt for a term as mutually agreed upon but not to exceed thre e (3) years beyond the Req. The contract shall include all other terms and conditions as agreed upon in w riting by the board and the superintendent. C. Prior to entering into a written contract with a superintendent, the board shall publicly disclose the names of the final three candidates being considere d for the position. If the final number of candidates is fewer than three, the board shall publicly disclose the names of the candidate(s). D. The boards of two or more school districts may contract with one superintendent to serve as superintendent of the school districts as provided in Section 4 Section 5-106A of this act title. D. E. No board of a school district having an average daily membership (ADM) of fewer than five hundred (500) pupils shall be prohibited from allowing a superintendent to s erve simultaneously as a principal. E. F. The chief executive officer of the board of education of a district in which a public developmental research school is established shall be the dire ctor of the school appointed a s provided in Section 1210.577 of t his title. SECTION 2. This act shall beco me effective July 1, 2022. SECTION 3. It being immediately necessary for the preservation of the public peace, health or safety, an emergency is hereby Req.
