BE IT ENACTED BY THE PEOPLE OF THE STATE OF OK LAHOMA: SECTION 1. NEW LAW A new section o f law to be codified in the Oklahoma Statutes as Section 21-110a of Title 11, unless there is created a duplication in numb ering, reads as follows: A. A territory may be detached from the corporate limits of a municipality when the governing municip ality has defunded the pol ice department at least once within the previous twenty-four (24) months. "Defunded" means the municipality has adopted a budget for a fiscal year that red uces appropriated monies to the municipal police department by five percent (5%) or greater compared to the previous fiscal year. A municipality shall not annex an area during a fiscal year that defunds the munici pal police department unless the budget of the police department is the same or exceeds what it was before it was defunded. C. Any annexed territory that wishes to detach from the governing municipality shall comply with all procedures in Section 21-110 of Title 11 of the Oklahoma Statutes . SECTION 2.
