AS INTRODUCED 
 
An Act relating to voter registration; amending 26 
O.S. 2011, Section 4 -109.3, as last amended by 
Section 1, Chapter 242, O.S.L. 2017 (26 O .S. Supp. 
2020, Section 4-109.3), which relates to application 
for voter registration; authorizing State Election 
Board to develop certain system; authorizing 
Secretary of the Board to provide certain info rmation 
to county election board; providing for aut omatic 
voter registration; prohibiting sending of ballots to 
certain persons; and providing an effective date . 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.    AMENDATORY     26 O.S. 2011, Section 4 -109.3, as 
last amended by Section 1, Chapter 242, O.S.L. 2017 (26 O.S. Supp. 
2020, Section 4-109.3), is amended to read as follows: 
Section 4-109.3. A.  When a qualified elec tor applies for 
issuance or renewal o f an Oklahoma driver license, or issuance of a 
state identification card i ssued pursuant to Section 6 -105 of Title 
47 of the Oklahoma Statutes, he or she shall be provided voter 
registration services as required by the National Voter Registration 
Act.  All completed paper voter registration applications sh all be 
transmitted by the agency accepting the application at the close of

business each week to the State Election Board in preaddressed, 
postage-prepaid envelopes pro vided by the State Election Board.  I f 
a person registers or declines to register to vot e, the office at 
which the person submits the voter registration application or the 
fact that the person declined to register shall remain confidential 
and will be used only for voter registration purposes . 
B.  A change of address for an Oklahoma driver li cense or state 
identification card submitted by a registered voter shall also serve 
as a change of address for voter registration purposes if the new 
address is within the same county where the voter is re gistered to 
vote.  If the new address is outside th e county where the vote r is 
currently registered to vote, the voter shall be sent a notice and 
application with instructions for registering to vote at the new 
address. A change of address for an Oklahoma driver license or 
state identification card shall not be used to update a voter 
registration address if the registrant states in writing that the 
change of address is not for voter registration purposes. 
C.  Motor license agents shall receive fifty cents ($0.50) per 
valid paper voter registration applicat ion or application for change 
in voter registration taken by themselves and employees of the motor 
license agent's office taken at the agent 's office, payable by the 
State Election Board. 
D.  The Oklahoma Tax Commission shall notify the Secretary of 
the State Election Board of m otor license agent appointments.  The

Oklahoma Department of Public Safety shall notify the Secretary of 
the State Election Board of motor licens e agents qualified to issue 
driver licenses. 
E.  The Secretary of the State Election Boa rd is authorized to 
develop with the Department of Public Safety a system to 
electronically transmit voter registration applications from motor 
license agencies to the State Election Board or county electi on 
boards.  Such system shall be consistent with th e requirements for 
electronic submission of voter registration applications provided in 
Section 4-109.4 of this title. 
F.  The Secretary of the State Election Board sha ll develop a 
system by which the Depa rtment of Public Safety and motor license 
agents shall provide to the Secr etary electronic records containing 
the legal name, age, residence, citizenship information and the 
electronic signature of each person who is a qualified elector or 
will be a qualified elector within the next two (2) years. 
G.  Upon receiving the electron ic record for and electronic 
signature of a qualified elector or a person who will become a 
qualified elector within the next two (2) years, th e Secretary shall 
provide the informati on to the county election board of the county 
in which the person may be r egistered or preregistered as a 
qualified elector.  The Secretary or county election board shall 
notify each person of the process to: 
1.  Decline being registered as a qualified ele ctor; or

2.  Adopt a political party affiliation. 
H.  If a person notified under subsection G of this section does 
not decline to be registered as an elector within twenty -one (21) 
calendar days after the Secretary or county election board issues 
the notification, the person's electronic record and electro nic 
signature submitted under subsection F of this section shall 
constitute a completed registration card for the person for purposes 
of this section.  The person sha ll be registered to vote if the 
county election board determines that the person is a qual ified 
elector and the person is not already registered to vote. 
I.  A county election board shall not send a ballot to, or add 
to an elector registration list, a pers on who meets eligibility 
requirements until at least twenty-one (21) calendar days after t he 
Secretary or county election board provided notification to the 
person as described in subsection G of this section. 
J. The Secretary of the State Election Board shall promulgate 
rules and procedures t o implement the requirements of this section. 
SECTION 2.  This act shall become effective November 1, 20 21.
