AS INTRODUCED 
 
An Act relating to presidential electors; amending 26 
O.S. 2011, Section 1 0-103, which relates to election 
of presidential electors; modifying time for election 
of presidential electors; modifying entity to elect 
presidential electors; establishing contingency for 
expiration of certain requirements; pr oviding 
exception upon enactment of certain federal law; and 
declaring an emergency. 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     AMENDATORY     26 O.S. 2011, Section 10 -103, is 
amended to read as follo ws: 
Section 10-103. A. On the third Tuesday after the first Monday 
in November in each year next preceding the expiration of the term 
of office of each President of the United States, the Legislature of 
this state shall convene pursuant to the provisions of Section 27A 
of Article 5 of the Oklahoma Constitution and shall elect a number 
of electors for President and Vice President equal to the number of 
United States Senators and United States Representatives whi ch the 
state is entitled to elect.  If a federal law is enacted pur suant to 
clause 1 of Section 4 of Article 1 of the United States Constitution

that requires security measures for elections including , but not 
limited to, voter identification requirements and the use of 
auditable paper ballots, the provisions of this subsection shall 
cease to be in effect on the effective date of su ch federal law. 
B. On Except as provided by su bsection A of this section, on 
the first Tuesday after the first Monday in Novem ber in each year 
next preceding the expiratio n of the term of office of each 
President of the United States, the registered voters of this state 
shall elect a number of electors for President and Vice President 
equal to the number of United States Senators and United States 
Representatives which the state is entitled to elect.  Said elector s 
shall be elected in the same manner as is provided for state 
officers. 
SECTION 2.  It being immediately necessary for the preservation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reason whereof this act shall take effect and 
be in full force from and after its passage and approval.
