AS INTRODUCED 
 
An Act relating to the Oklahoma Health Care 
Authority; requiring certain reimb ursement of 
services provided through telemedicine; directing the 
Authority to seek certain federa l approval; defining 
term; providing for codification; providing an 
effective date; and declaring an emergency. 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 5025.1 of Title 63, unless there 
is created a duplication in numbering, reads as fo llows: 
The Oklahoma Health C are Authority shall reimburse a contracted 
provider for the diagnosis, consultation or treatment of a patient 
delivered through telemedicine services on the same basis and at 
least at the rate of reimbursement that the Authority is responsible 
for coverage for the p rovision of the same, or substantially 
similar, service through in-person diagnosis, consultation or 
treatment. The Authority shall seek any federal approval necessary 
to implement this section. As used in this section, “telemedicine”

shall have the same meaning as provided by Section 478 of Title 59 
of the Oklahoma Statute s. 
SECTION 2.  This act shall be come effective July 1, 2021. 
SECTION 3.  It being immediately necessary for the pre servation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reason whereof this act shall take effect and 
be in full force from and after its passage and approval.
