AS INTRODUCED 
 
An Act relating to pharmacy; authorizing licensed 
pharmacist to compound certain nonsterile 
preparations for specified individuals under certain 
conditions; limiting amount in stock; authorizing 
licensed pharmacist to dispense and ship certain 
nonsterile preparations to specified individuals 
under certain conditions ; prohibiting certain 
shipments; specifying applic ability of section; 
providing for codification; and providing an 
effective date. 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 353.19A of Title 59, unless 
there is created a duplication in numbering, reads as follows: 
A.  A licensed pharmacist may compound one or more nonsterile 
preparations for office use by a licensed practitioner pursuant to a 
valid order or orders by the licensed practitioner .  This subsection 
shall apply to a preparation containing either prescription or 
nonprescription ingredients, or both. 
B.  1. A licensed pharmacist may compound one or more non-
sterile preparations consisting only of nonprescription ingredients

for over-the-counter use by one or more customers or anticipated 
customers. Such preparations shall not require a prescription. 
2.  The amount in stock at any given time of each preparation 
for over-the-counter use shall not exceed what the pharmacist 
reasonably believes would be necessary to fill two weeks’ worth of 
orders. 
3.  A licensed pharmacist may dispense or ship one or more non-
sterile preparations for over-the-counter use to a customer if: 
a. the preparation was compounded in compliance with 
paragraph 1 of this subsection, and 
b. the pharmacist deems the preparation to be appropriate 
for the customer. 
4.  A pharmacist shall not ship any preparations for over-the-
counter use out of this state. No more than ten percent (10%) of 
the volume of any one prep aration shall be shipped to a customer or 
customers outside of a fifty-mile radius of the pharmacy. 
C.  In the event the manufacture, sale and consumption of 
products containing marijuana or tetrahydrocannabinol becomes legal 
under federal law, a licensed pharmacist may compound one or more 
nonsterile preparations containing such ingredients, to the extent 
allowed under federal law, for one or more customers or anticipated 
customers.  The pharmacis t shall only dispense such preparations to 
one or more customers currently licensed as patients by the Oklahoma

Medical Marijuana Authority and shall verify each license prior to 
purchase. 
D.  This section shall apply to any pharmacist who owns, is 
employed by or is under contract with any pharmacy licensed by the 
State Board of Pharmacy and located in this state.  This section 
shall not be construed to apply only to certain types of pharmacies 
including, but not limited to, a compounding phar macy. 
SECTION 2.  This act shall become effective November 1 , 2021.
