S upp. 2020, Section 1716), which relates to the larceny of livestock or implements of husbandry; requiring registry of certain persons in the Livestock Offender Registry; requiring submission of certain records to the Oklahoma Department of Agriculture, Foo d, and Forestry; providing for codification; a nd providing an effective date. BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: SECTION 1. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Secti on 2-16.1 of Title 2, unless there is created a duplication in numbering, reads as follows: A. The Oklahoma Department of Agriculture, Food, and Forestry is authorized to create and maintain the Livestock Offender Registry. Access to the registry shall b e provided to the public on the Department’s website. Req. The Livestock Offender Registry shall contain all persons convicted of violating Section 1716 of Title 21 of the Oklahoma Statutes. C. The Department may promulgate rules to implement the provisions of this section. D. The Department is autho rized to contract with a statewide livestock organization, as defined in Section 4 -2 of Title 2 of the Oklahoma Statutes, to create a nd maintain the Livestock Offender Registry. SECTION 2. AMENDATORY 21 O.S. 2011, Section 1716, as amended by Section 1, Chapter 89, O.S.L. 2016 (21 O.S. Supp. 20 20, Section 1716), is amended to read as follows: Section 1716. A. An y person in this state who shall steal any horse, jackass, jennet, mule, cow, hog or implement of husbandry as defined in Section 1-125 of Title 47 of the Oklahoma Statutes shall, upon conviction, be guilty of a felony punishable by imprisonment in the custody of the Department of Corrections for a term of not less than three (3) years nor more than ten (10) years, or by a fin e in an amount that is equal to three times the value of animals and machinery that were stolen but not more than Five Hundred Thousa nd Dollars ($500,000.00), or by both such fine and imprisonment. Each head of cattle stolen may constitute a separate offe nse and may be punishable as a separate violation. Req. Any person in this state who shall steal any dog, sheep or goat shall, upon conviction, be guilty of a felony punishable by imprisonment in the custody of the Department of Corrections for a term of not less than six (6) months nor more than three (3) years, or by a fine in an amount that is equal to three times the value of the animals that were stolen but not more than Five Hundred Thousand Dollars ($500,000.00), or by both such fine and imprisonment. C. The word “horse” as used in this section includes all animals of the equine species, and the word “cow” includes all animals of the bovine species. D. Persons convicted of violating the provisions of subs ection A of this section shall be registered b y the Oklahoma Department of Agriculture, Food, and Forestry in the Livestock Offender Registry created in Section 1 of this act. E. The county in which the offender is convicted shall submit a certified copy of the judgment and sentence confirming the conviction for entry in the Livestock Offender Registry to the Oklahoma Department of Agriculture, Food, and Forestry or, if designated by the Department, to a statewide livestock organization.
