AS INTRODUCED 
 
An Act relating to the Oklahoma Tourism an d 
Recreation Department employees; amendi ng 74 O.S. 
2011, Section 2242, which rel ates to unclassified 
positions; reclassifying positions on certain date; 
authorizing continuation of merit positions until 
certain occurrences; requiring certain notice be 
given to employee upon reclassification of position; 
providing an effective date; and declaring an 
emergency. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     AMENDATORY     74 O.S. 2011, Section 2242, is 
amended to read as follows: 
Section 2242. The following offices and positions in the 
Beginning July 1, 2021, employees of the Oklahoma Tourism and 
Recreation Department shall be in the unclassified service and shall 
not be subject to the Merit System of Personnel Administration : 
1.  The Executive Director, the Deputy Director, directors of 
the divisions of the Department and administrative assistant of 
each, and not more than four positions involved in the executive 
management of the Department;

2.  All positions in the Traveler Response Info rmation Program; 
3.  All professional or managerial posit ions whose principal 
function is one of the following: 
a. marketing and promotion of travel and tourism to and 
within the state, 
b. promoting the state as a viable location for producing 
motion pictures and television programs and for 
recording music, 
c. developing, producing, and on -air broadcasting of 
“Discover Oklahoma”, the weekly promotional television 
program, 
d. not more than fifteen positions performing financial 
management functions for the D epartment, 
e. not more than five positions performing hum an 
resources functions for the Department, and 
f. not more than two positions performing information 
services functions for the Department; 
4.  Any position associated with the development and produc tion 
of “Oklahoma Today” magazine; and 
5.  Any position in the Division of State Parks utilized in the 
operation and administration of state resorts, cabins, lodges, and 
golf courses.  An employee of the Oklahoma Tourism and Recreation 
Department who is in the Merit System of Personnel Administration on 
July 1, 2021, may elect to retain their merit classifica tion until

such position is vacated , abolished or the employee elects 
unclassified status.  Any position changed from a merit position to 
unclassified service within the Oklahoma Tourism and Recreation 
Department on or after July 1, 2021, shall require a thirty-day 
written notice be given to the current employee filling such 
position. 
SECTION 2.  This act shall become effective July 1, 2021. 
SECTION 3.  It being immediately necessa ry for the preservation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reason whereof thi s act shall take effect and 
be in full force from and after its passage and app roval.
