AS INTRODUCED 
 
An Act relating to smoking in public places; amending 
63 O.S. 2011, Section 1 -1527, as amended by Section 
2, Chapter 187, O.S.L. 2013 (63 O.S. Supp. 2020, 
Section 1-1527), which relates to legislative intent; 
eliminating certain preemption; authorizing adoption 
of certain regulations; defining term; prohibiting 
certain local laws from being less stringent than 
state law; broadening prov isions to apply to vapor 
products; updating statutory reference ; and providing 
an effective date. 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     AMENDATORY     63 O.S. 2011, Section 1 -1527, as 
amended by Section 2, Chapter 187, O.S.L . 2013 (63 O.S. Supp. 2020, 
Section 1-1527), is amended to read as follows: 
Section 1-1527. The State Legislature by adopting this act the 
Smoking in Public Places Act intends to preempt any other regulation 
promulgated to control smoking in public places and to standardize 
laws that authorize governmental subdivisions may to adopt 
regulations to control or prohibit smoking or vaping in public 
places.  As used in this section, “public place” shall have the same 
meaning as provided by Section 1-1522 of this title.  Cities and

towns may enact and enforce laws prohibiting and penalizing conduct 
under provisions of this act, but the provisions of such laws shall 
be the same as provided in this act and the enforcement provisions 
under such laws shall not the Smoking in Public Places Act .  Such 
laws may be more, but not less, stringent than those of this act ; 
provided, however, that cities .  Cities and towns shall be 
authorized to enact laws restricting smoking or vaping on properties 
owned or operated by the resp ective governing bodies.  Nothing in 
this section shall be constru ed as to prevent county or municipal 
governments, at the discretion of the respective governing bodies, 
from prohibiting smoking in or on property owned or opera ted by the 
respective governing bodies. 
SECTION 2.  This act shall become effec tive November 1, 2021.
