AS INTRODUCED 
 
A Joint Resolution directing the Secretary of State 
to refer to the peopl e for their approval or 
rejection a proposed amend ment to the Oklahoma 
Constitution by adding a new Section 4 to Article 
XXIV; requiring proposed constitutional amendment s or 
state questions to receive certain majority vote to 
take statewide effect; allowi ng proposed 
constitutional amendments or state quest ions to take 
effect in only counties that approved under certain 
circumstances; providing ballot title; and directing 
filing. 
 
 
 
 
 
BE IT RESOLVED BY THE SENAT E AND THE HOUSE OF REPRESENTATIVES OF THE 
2ND SESSION OF THE 58TH OKLAHOMA LEGISLATURE: 
SECTION 1.  The Secretary of State shal l refer to the people for 
their approval or rejection, as and in the manner provided by law, 
the following propos ed amendment to the Oklahoma Constitut ion by 
adding a new Section 4 of Article XXIV to read as follows: 
Section 4.  A.  No amendment to the Oklahoma Constitution or 
other state question that removes a right of the residents of this 
state shall take effect statewide unless:

1.  A majority of electors statewide vote in favor of the 
proposed amendment or state question; and 
2.  A majority of electors in two-thirds of all counties in this 
state vote in favor of the prop osed amendment or state question. 
B.  An amendment to the Oklahoma Cons titution or other state 
question that removes a right of the residents of this state that 
receives a majority of electors pursuant to paragraph 1 of 
subsection A of this section, but does not receive a majority of 
electors pursuant to paragraph 2 of subsection A of this section 
shall take effect only in such countie s where a majority of electors 
voted in favor of the proposed amendment or state question. 
SECTION 2.  The Ballot Title for the propo sed Constitutional 
amendment as set forth in SECTION 1 of this resolution shall be in 
the following form:

Legislative Referendum No. ____ State Question No. ____ 
THE GIST OF THE PROPOSITIO N IS AS FOLLOWS: 
This measure would create a new Section 4 of Article 24 of the 
Oklahoma Constitution.  The measure would require a propose d 
constitutional amendm ent or state question that removes a right 
of residents of this state to receive a majority vote of 
electors statewide and a majority vote of electors in t wo-thirds 
of the counties to take effect statewide.  The measure would

amendment or state question received a majo rity vote of electors 
in that county.

SECTION 3.  The President Pro Tempore of the Senate shall, 
immediately after the passage of this resolution, prepare and file 
one copy thereof, including the Ballot Title set forth in SECTION 2 
hereof, with the Secretary of State and one copy with the Attorney 
General.
