AS INTRODUCED 
An Act relating to child care; mandating payment of 
child care provider c ontract on weekly basis; 
requiring child care reimbursement to be based on 
enrollment and daily attendance; providing for rate 
determination based on tier level; providing for 
potential loss of benefit for certain absences; 
requiring Department of Human Services to conduct 
annual market rate survey; providing for 
codification; providing a n effective date; and 
declaring an emergency. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 230.74 of Titl e 56, unless there 
is created a duplication in numbering, reads as follows: 
A.  A child care facility licensed by the Department of Human 
Services with a current child care provider c ontract shall receive 
reimbursement at the beginning of each week , fifty percent (50%) 
which shall be based on enrollment and fifty percent (50%) which 
shall be based on actual daily attendance.  The rate shall be 
determined by the tier level of the child care facility where the

child is enrolled and the age of each child on th e contract for the 
child care subsidy program minus the family copayment. 
B.  The Electronic Benefit Transfer (EBT) card of the child 
shall only be swiped in on days in attendance and shall not be 
required to be swiped out.  In the event that a child misse s ten 
(10) consecutive days of attendance without prior approval from the 
child care facility and a caseworker from the Department, the child 
may lose approval for the child care subsidy program and may be 
required to reapply in the program. 
C.  The Department shall conduct an annual market rate survey to 
ensure compliance with the seventy -fifth percentile (75%) payment 
rate as required by the federal Child Care and Development Block 
Grant. 
SECTION 2.  This act shall become effective July 1 , 2023. 
SECTION 3.  It being immediately necessary for the preservation of 
the public peace, health or safety, an emergency is hereby declared 
to exist, by reason whereof this act shall take effect and be in 
full force from and after its pas sage and approval.
