HOUSE BILL 1943 By: McCall
AS INTRODUCED
An Act relating to wastewater treatment plants;
exempting certain wa stewater treatment plants f rom
new rules for certain term of years; r equiring plant
update following expir ation of term of years;
providing for codificati on; and providing an
effective date.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 2-6-404 of Title 27A, unless
there is created a duplication in numbering, reads as follows:
Following the approval of an application for the construction of
any new wastewater treatment plant by a municipalit y, county or
water district, any new rules or regulations promulgated by the
Department of Environmental Quality regarding construction
requirements for waste water treatment plants shall not apply to the
new wastewater treatment plant until after the expir ation of a term
of fifteen (15) years. Following the expiration of the term of

fifteen (15) years, the operator shall be required to update the
plant to conform with current Department rules to remain in
compliance.
SECTION 2. This act shall become effective November 1, 2023.
