COMMITTEE SUBSTITUTE
An Act relating to schools; amending 70 O.S. 202 1,
Section 8-103.2, which relates to transfer student
participation in athletic competition; granting
eligibility for certain transfer students; requiring
immediate eligibility for students who transfer prior
to sophomore year; modifying criteria of a one -year
waiting period for cert ain transfer students; and
providing an effective date.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. AMENDATORY 70 O.S. 2021, Section 8 -103.2, is
amended to read as foll ows:
Section 8-103.2 A. Except as otherwise provided, a student who
enrolls transfers, pursuant to the Education Open Transfer Act or
pursuant to Section 2 8-113 of this act title, in to a school
district in which the student is not a resident shall not be
eligible to participate in school -related extramural athletic
competition governed by the Oklahoma Secondary School Activities

Association for a period of one (1) year f rom on the first day of
attendance at the re ceiving school unless the transfer is fr om a
school district which does not o ffer the grade the student is
entitled to pursue if the student did not letter in the school -
related extramural athletic competition at the student's prior
school.
B. A student who transfers prior to his or her sophomo re year
of high school, pursuant to the Education Open Transfer Act or
Section 8-113 of this title, shall be eligible to participa te in
school-related extramural athletic competition governed by the
Oklahoma Secondary School Activities Association on th e first day of
attendance at the receivi ng school.
C. If the student is granted an emergency transfer p ursuant to
Section 8-104 of this title, was granted a transfer for any reason
prior to January 1, 2000, or enrolls pursuant to the Education Open
Transfer Act and qualifies for a hardship waiv er pursuant to the
rules of the Oklahoma Secondary School Activi ties Association,
eligibility to participate in school -related extramural athle tic
competition shall be determined by the Oklahoma Secondary School
Activities Association. If the student does not meet the criteria
provided in subsection A or B of this sec tion and does not qualify
for a hardship waiver, the student shall not be eligibl e to
participate in school -related extramural athletic competition
governed by the Oklahoma Secondary School Ac tivities Association for

a period of one (1) year from the f irst day of attendance at the
receiving school.
SECTION 2. This act shall become effective November 1, 2023.
