REPEALER 63 O.S. 2021, Sections 1-879.2, and 1-879.3, are hereby repealed. SECTION 2. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 1-879.5 of Title 63, unless there is created a duplication in numbering, reads as follows: This act shall be known and may be cited as the "Alzheimer's Disease and Related Dementia Infrastructure Act". SECTION 3. NEW LAW A new section of law t o be codified in the Oklahoma Statutes as Section 1-879.6 of Title 63, unless there is created a duplication in numbering, reads as follows: ENGR. H. B. NO. 2747 Page 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 The purpose of this act is to develop a coordinated state structure and state and community r esponse to dementia th at meets the growing need for dementia -specific services, research and community education, and caregiver support. SECTION 4. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 1-879.7 of Title 63, unless there is created a duplication in numbering, reads as follows: As used in this act: 1. "Alzheimer's and Related Dementia State Plan" means a plan developed by the state in conjunction with stakeholders for meeting the needs of individuals with Alzheimer's disease and related dementia or diagnosis and their caregivers ; 2. "Caregiver" means any person other than a paid provider who provides care for a person with dementia; and 3. "Dementia" means a degenerative disease of the centra l nervous system chara cterized especially by premature cognitive deterioration. This includes Alzheimer 's disease and related dementia and diagnoses which are similarly marked by irreversible deterioration of intellectual faculties with concomitant emotion al disturbance resulting from organic brain disorder, such as: a. Chronic Traumatic Encephalopathy , b. Creutzfeldt-Jakob Syndrome, c. Frontotemporal dementias , d. Huntington's disease, ENGR. H. B. NO. 2747 Page 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 e. Korsakoff's Syndrome, f. Lewy-body disease, g. Parkinson's disease, h. Progressive supranuclear palsy, i. Vascular dementia, or j. any other neurocognitive brain disorder that results in the irreversible deterioration of intellectual faculties. SECTION 5. NEW LAW A new section of law to be codified in the Oklahoma Statut es as Section 1-879.8 of Title 63, unless there is created a duplication in numbering, reads a s follows: A. In the State Department of Health, there i s hereby created an Office of Alzheimer's Disease and Related Dementia Resource Coordination to provide statewide coordination, service system development, and information on education, support, and other available services. The Office shall provide the foll owing: 1. Initiate the development of systems which coordinate the delivery of programs and services; 2. Facilitate the coordination and integration of research, program development, planning, a nd quality assurance; 3. Identify potential users of servic es and gaps in the service delivery system and expand methods and resources to e nhance statewide services; ENGR. H. B. Provide technical assistance for the application of relevant federal and state grants; 6. Provide technical assista nce for state and loca l initiatives to serve individuals, families, and caregivers; 7. Work with relevant State Dep artment of Health staff to recommend public policy concernin g Alzheimer's disease and related dementia to state policymakers; 8. Facilitate the coordination of A lzheimer's State Plan re- write every four (4) years, stakeholder involvement in the re -write, amendments to the Alzheimer 's State Plan during the re -write interim period, and any progress reports, updates, and other communication regarding the Alzheimer's State Plan; 9. Submit an annual report that details Alzheimer 's State Plan implementation progress, information on service delivery system developments and gaps, research updates, and resources, outreach, and information to The Advancement of Wellness A dvisory Council as defined in Section 1-103a.1 of Title 63 of the Oklahoma Statutes, for review and approval. Upon approval the annual report shall be provided to the Secretary of Health and Human Services, the Office of the Governor, the Oklahoma State Legislature, and made publicly available on the State Department of Health 's website; and ENGR. Facilitate the coordination and integration of educational initiatives for health care providers on the importance and value of early detection and timely diagnosis of cognitive impairment, validated cognitive assessment tools, and increasing understanding and awareness of early warning signs of Alzheimer 's disease and other types of dementia and how to reduce the risk of cognit ive decline. B. The Office of Alzheimer's Disease and Related Dementia Resource Coordination shall maintain on staff at least one (1 ) dementia services manager. The dementia services manager shall be a full-time, permanent employee and shall be responsibl e for the staffing and operational det ails of the Office of Alzheimer's Disease and Related Dementia Resource Coordination. SECTION 6. NEW LAW A new section of law to b e codified in the Oklahoma Statutes as Section 1-879.9 of Title 63, unless there is created a duplicat ion in numbering, reads as follows: A. There is hereby created in the State Treasury, subject to the availability of funds, a revolving fund for the Stat e Department of Health's Office of Alzh eimer's Disease and Rel ated Dementia Resource Coordination to b e designated the Alzheimer's Disease and Related Dementia Research Fund . The Alzheimer's Disease and Related Dementia Research Fund shall be a continuing fund, not subject to fiscal year limitations, and shall consist of all monies d eposited to the credit of the fund by law. All monies accruing to the credit ENGR. H. B. Expenditures from the fu nd shall be made upon warrants issued by the State Treasurer against claims filed as prescribed by law with the Dire ctor of the Office of Management and Enterprise Services for approval and payment. B. The awards shall be made through an awards committee of seven (7) members, coordinated by the dementia services manager consisting of three (3) representatives from the scientific and medical communities, three (3) members of the general public, and the dementia services manager. C. The awards shall be give n annually to selected applicants residing and performing research in the state of Oklahoma in order to support research into the causes of Alzheimer's disease and related disorders, methods of treatment, ways that families can cope with the stresses of th e disease, and the imp act of the disease on Oklahoma. D. Information on the awardee, project, and dollars awarded shall be included in the annual report as defined in paragraph 9 of Section 5 of this act. SECTION 7. NEW LAW A new s ection of law to be co dified in the Oklahoma Statutes as Section 1-879.10 of Title 63, unless there is created a dup lication in numbering, reads as follows: ENGR. H. B. The Dementia Caregiver Support Group and Edu cation Program Development Fund shall be a continuing fund, not subject to fiscal year limitations, and shall consist of all monies deposited to the credit of the fund by law. All monies accruing to the credit of t he fund are hereby appropriated and may b e budgeted and expende d by the State Department of Health's Office of Alzheimer's Disease and Related Dementia Resource Coordination for the purpose of providing funds for the Dementia Caregiver Support Group and Education Program Development Fund. Expenditures from the fund s hall be made upon warrants issued by the State T reasurer against claims filed as prescribed by law with the Director o f the Office of Manag ement and Enterprise Services for approval and payment . B. The Dementia Support and Education Program Development Fund shall be administered b y the State Department of Health's Office of Alzheimer's Disease and Related Dementia Resource Coordination. The awards shall be made through an awards committee of f ive (5) members, facilitated by the demen tia services manager consisting of representatives from the Alzheimer's Disease and Related Dementia State Plan writing committee. The awards shall be given annually to non-profit applicants residing in the stat e of Oklahoma in areas of the state meeti ng the Census Bureau classification of rural in order to support community efforts to establish Alzheimer 's disease and related dementia caregiver support groups and evidence-based community education programs. D. The Office of Alzheimer's Disease and Related Dementia Resource Coordination shall include information on the awardee(s), project(s), and dollars awarded in the annual report as define d in paragraph 9 of Section 5 of this act. E. The Dementia Caregiver Support Group and Education Program Development Fund shall sunset five (5) years from the effective date of this act. SECTION 8.
