AS INTRODUCED 
 
An Act relating to safe sleep; amending 63 O.S. 2021, 
Section 1-1002.2, which relates to retailers of bunk 
beds; removing certain duty o f State Board of Heal th; 
requiring retailers to comply with certain 
requirements; and providing an effective date. 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     AMENDATORY     63 O.S. 2021, Section 1-1002.2, is 
amended to read as follows: 
Section 1-1002.2 The State Board of Health shall promulgate 
rules establishing re quirements for retailers of bunk beds which 
shall include, but not be limited to, requirements that Retailers of 
bunk beds shall comply wi th the following requirements: 
1. Each set of bunk beds must be posted with an indelible 
warning which conforms with American Society for Testing and 
Materials Voluntary Standards International or U.S. Consumer Product 
Safety Commission Standards; and

2.  No retailer shall sell a set of bunk beds which does not 
limit the space between the lower edge of the guard rail and the 
upper edge of the bed frame of the upper b unk bed to three and one-
half (3 1/2) inches or less. 
SECTION 2.  This act shall become effective November 1, 2023.
