COMMITTEE SUBSTITUTE 
 
An Act relating to higher education; amending 70 O.S. 
2021, Section 626.6, which relates to the Oklahoma 
Higher Education Tuition A id Act; removing certain 
eligibility provision; limiting eligibility of 
certain incarcerated individuals; providing an 
effective date; and declaring an emergency. 
 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STA TE OF OKLAHOMA: 
SECTION 1.     AMENDATORY     70 O.S. 2021, Section 626.6, is 
amended to read as follows: 
Section 626.6 A.  No person shall be awarded a s tate tuition 
aid grant unless the person:

1.  Is a resident of the State of Oklahoma this state.  Such 
residency shall meet requirements as set out by the Oklahoma State 
Regents for Higher Education ; 
2.  Has demonstrated financial need for such tuition aid as 
determined by Sections 626.2 and 626.7 of this titl e and in 
accordance with proced ures to be established by the Oklahom a State 
Regents for Higher Education; 
3.  Is not incarcerated in a state, f ederal or private 
correctional facility; 
4. Has demonstrated high moral character, good citizenship , and 
dedication to American ideals; 
5. 4.  Has applied for state tuition aid and has been determined 
to be eligible for such tuition aid; and 
6. 5.  Has complied with all the rules adopted pursuant to the 
Oklahoma Higher Education Tuition Aid Act for the award, regula tion, 
and administration of sta te college tuition aid. 
B.  No person shall be awarded a state tuition ai d grant if the 
person is incarcerated in a state , federal, or private correctional 
facility and enrolled in a program structured primarily for virtual 
learning.  A state tuition aid grant shal l only be awarded to an 
individual who is incarcerated in a state , federal, or private 
correctional facility if the individua l is within (5) years from 
being released from incarceration. 
SECTION 2.  This act shall become effective July 1, 2023.

SECTION 3.  It being immediately necessary for the preservation 
of the public peace, health , or safety, an emergency is hereby 
declared to exist, by reason whereof thi s act shall take effect and 
be in full force from and after its passage and approval.
