SENATE JOINT

AS INTRODUCED 
 
A Joint Resolution directing the Secretary of State 
to refer to the people f or their approval or 
rejection a proposed amendment to the Oklahoma 
Constitution by adding a new Section 9 E to Article X; 
allowing for the creation of Public Infrastructure 
Districts; requiring certain con ditions for the 
creation of a public infrastructure district; 
allowing municipalities to limit powers of the public 
infrastructure districts; authorizing additional 
levies to be imposed for certain purpose; authorizing 
the Legislature to en act laws necessary for the 
implementation of public infrastructure districts; 
providing ballot title; and directing fil ing. 
 
 
 
 
 
BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE 
1ST SESSION OF THE 56TH OKLAHOMA LEGISLATURE: 
SECTION 1.  The Secretary of State shall re fer to the people for 
their approval or rejection, as and in the manner provided by law, 
the following proposed amendment to the Oklahoma Constitution by 
adding a new Section 9 E to Article X to read as follows: 
Section 9.  A.  There is hereby created Public Infrastructure 
Districts.

B.  Municipalities may approve the creation of public 
infrastructure districts, which may incur indebtedness and issue 
public infrastructure district bonds to pay for all or part of the 
cost of public improvements within such di stricts.  The cost of all 
indebtedness so incurred shall be levi ed and assessed by the board 
of trustees of a public infrastructure district on the property 
benefited by such improvements following the passage and approval of 
the organization of a public infrastructure district pursuant to 
subsection C of this section . The board shall collect the special 
assessments so levied and use the same to reimburse the public 
infrastructure district for the amount paid or to be paid by it on 
the bonds issued for such improvements not to exceed ten (10) mills 
for the purpose of p roviding funds for the purpose of support, 
organization, operation , and maintenance of such services . 
C.  A public infrastructure district shall not be created 
unless: 
1.  A petition, if there are any registered voters within the 
applicable area, is filed with the municipality that contains the 
signatures of one hundred percent (100%) of regis tered voters within 
the applicable area approving the creation of the public 
infrastructure district; or 
2.  A petition is filed with the municipality that contains the 
signatures of one hundred percent (100 %) of surface property owners

within the applicable area consenting to the creation of the public 
infrastructure district. 
D.  The municipality may impose limitations on the powers of the 
public infrastructure distr ict through the governing document 
presented by the public infrastructure d istrict applicant. 
E.  The levy shall be in addition to all oth er levies authorized 
by this Constitution, and when app roved, shall be made for the 
repayment of public infras tructure districts bonds issued by the 
public infrastructure districts for the public improvements agreed 
upon by the voters of the district as pr ovided by the governin g 
document. 
F.  The Legislature s hall be authorized to enact such laws as 
may be necessary in ord er to implement public inf rastructure 
districts in the State of Oklahoma. 
SECTION 2.  The Ballot Title for the proposed C onstitutional 
amendment as set forth in SECTION 1 of th is resolution shall be in 
the following form:

THE GIST OF THE PROPOSITION IS A S FOLLOWS: 
This measure adds a new section of law to t he State 
Constitution.  It adds Section 9 E to Article 10.  It allows for 
the creation of public infrastruc ture districts.  It provides 
for the issuance of public infrastructure bonds by the pu blic

It requires a one hundred percent approval of voters in the 
district to become created .

SECTION 3.  The President Pro Tempore of the Senate shall, 
immediately after the passage of th is resolution, prepare and file 
one copy thereof, including the Ballot Title set forth in SECTION 2 
hereof, with the Secretary of State a nd one copy with the Attorney 
General.
