AS INTRODUCED 
 
An Act relating to firearms; providing mandatory 
waiting period before purchasing firearms; defining 
terms; making certain acts unlawf ul; providing 
penalties; authorizing the inspection of fi rearm 
sales records by law enforcement agencies; providing 
exceptions to mandatory wa iting period; providing for 
codification; and providing an effective date. 
 
 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 1288.1 of Title 21, unless there 
is created a duplication in numbering, reads as follows: 
A.  A mandatory waiting period is imposed between the purchase 
and delivery of a firearm.  The mandatory waiting period shall be 
three days, excluding weekends and legal holidays . 
B.  As used in this section: 
1. "Firearm" means a rifle, pistol or shotgun; 
2.  "Purchase" means the transfer of money or other valuable 
consideration to the retailer ; and

2.  "Retailer" means and includes a licensed importer, licensed 
manufacturer, or licensed dealer engaged i n the business of making 
firearm sales at retail or for distribution, or use , or consumption, 
or storage to be used or consumed in this state . 
C.  1.  It shall be unlawful for an y retailer, or any employee 
or agent of a retailer, to deliver a firearm befor e the expiration 
of the three-day waiting period. 
2.  It shall be unlawful f or a purchaser to obtain delivery of a 
firearm by fraud, false pretense, or false representation. 
D.  Any person who violates the provisions of subsection C of 
this section shall, upon conviction, be guilty of a felony. 
E.  Records of firearm sales shall be available for inspection 
by any law enforcement agency during normal business hours. 
F.  The waiting period specified in subsection A of this section 
shall not apply in the following circumstances: 
1.  When a firearm is being purchased by a holder of a handgun 
license issued pursuant to the provisions of the Oklahoma Self-
Defense Act; 
2.  To a trade-in of another firearm ; 
3.  To the purchase of a rifle or shotgun, upon the person 
successfully completing a minimum of a sixteen hour hunter safety 
course and possessing a hunter safety certificat e issued by the 
Department of Wildlife; or

4.  When a rifle or shotgun is being p urchased by a law 
enforcement officer, correctional officer, or servicemember. 
SECTION 2.  This act shall become effect ive November 1, 2023.
