AS INTRODUCED 
 
An Act relating to schools; amending 70 O.S. 2021, 
Section 11-106.1, which relates to inspection of 
instructional material; requ iring all material 
purchased or made available on school property to be 
subject to inspection; modifying who may inspect the 
material; providing for material which i s protected 
by copyright law; directing inspection on school 
property; authorizing limitati on of inspection to 
comply with copyright laws ; modifying definition of 
instructional material ; defining professional 
development material ; providing an effective da te; 
and declaring an emergency . 
 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     AMENDATORY     70 O.S. 2021, Section 11 -106.1, is 
amended to read as follows: 
Section 11-106.1 A.  All material purchased by a public school 
or made available on school property, including professional 
development material and instructional material, including but not 
limited to teacher manuals, films, tapes , or other supplementary 
instructional material in any format, used by a public school as 
part of the educational curriculum, shall be available for

inspection by the parents or guardians of students enrolled in the 
school, members of the board of education of the school district, 
members of the State Board o f Education, employees of the State 
Department of Education, and legislators. 
B.  Each school district shal l develop and adopt policies 
pertaining to the inspection of professional development material 
and instructional materials in consultation with parents an d 
guardians material.  The policies shall incl ude procedures for 
granting a request by a parent or guardian for reasonable access to 
professional development material and instructional material within 
a reasonable period of time after the request is received.  If the 
professional development material or instructional material being 
requested is protected by copyright law, the school district shall 
provide reasonable access for the material to be inspected on school 
property.  The school district may limit unauthorized duplication or 
dissemination of the material in compliance with applicable 
copyright laws. 
C.  For the purposes of this section , "instructional: 
1. "Instructional material" means instructional content that is 
provided to a student, regardless of the form at, including printed 
or representational materials, library materials, audio-visual 
materials, and materials in electronic or digital formats ; and

2.  "Professional development ma terial" means tools, resources, 
and training sessions, regardless of format, for school personnel to 
improve their teaching quality , effectiveness, and teambuilding. 
SECTION 2.  This act shall become effective July 1, 2023. 
SECTION 3.  It being immediately necessary for the preservation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reason whereof thi s act shall take effect and 
be in full force from and after its passage and approval.
