HOUSE BILL 2249 By: Burns
AS INTRODUCED
An Act relating to schools; amending 70 O.S. 2021,
Section 8-103.2, which relates to student transfers
participating in certain athletic c ompetition;
granting eligibility for certain students who
transfer during summer break; requiring immediate
eligibility for dependents of certain military
members; providing exception for certain students who
qualify for a hardship waiver; modifying criter ia of
a one-year waiting period for certain students; and
providing an effective date .
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. AMENDATORY 70 O.S. 2021, Section 8 -103.2, is
amended to read as f ollows:
Section 8-103.2 A. Except as otherwise provided, a student who
enrolls transfers during summer break when school is not in session ,
pursuant to the Education Open Transfer Act or pursuant to Section 2
8-113 of this act title, in to a school district in which the
student is not a resident shall not be eligible to participate in
school-related extramural athletic competition governed by the
Oklahoma Secondary School Activities Association for a period of one

(1) year from on the first day of attenda nce at the receiving school
unless the transfer is from a school district which does not offer
the grade the student is entitled to pursue .
B. A student who is the dependent child of a member of the
active uniformed military services of the United States who
transfers pursuant to subsection B of Section 8 -103.1 of this title
shall be eligible to participa te in school-related extramural
athletic competition governed by the Oklahoma Secondary School
Activities Association on th e first day of attendance at th e
receiving school.
C. If the student is granted an emergency transfer pursuant to
Section 8-104 of this title, was granted a transfer for any reason
prior to January 1, 2000, or enrolls transfers during the school
year or transfers more than one time pursuant to the Education Open
Transfer Act and qualifies for a hardship waiver pursuant to the
rules of the Oklahoma Secondary School Activities Association,
eligibility to participate in school -related extramural athle tic
competition shall be determined by the Oklahoma Secondary School
Activities Association. If the student does not meet the criteria
provided in subsection A or B of this section and does not qualify
for a hardship waiver, the student shall not be eligibl e to
participate in school -related extramural athletic competition
governed by the Oklahoma Secondary School Activities Association for

a period of one (1) year from the f irst day of attendance at the
receiving school.
SECTION 2. This act shall become effective November 1, 2023.
