NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 24-100.9 of Title 70, unless there is created a duplication in numbering, reads as follows: A. This act shall be known and may be cited as the "Student Digital Safety and A wareness Act". Subject to the availability of funds , public school boards of education shall adopt and implement di gital safety policies to enhance digital safet y measures at school and utilize the vendor selected pursuant to subsection E of this section to provide a digital monitoring platform to ensure complian ce. The policies shall address the following key components: 1. Filtering and monitoring, which shall include implementation of real-time filtering and mo nitoring of internet content accessed by students to block harmful and inappropriate m aterial, as well as to identify potential safety threats; 2. Cyberbullying detection, which shall utilize digital safety solutions to detect and prevent cyberbullying in cidents by monitoring digital communications and onli ne interactions for signs of bullying or harassment; 3. Self-harm and suicide prevention, which shall deploy monitoring features that identify online content related to self- harm or suicide, and enable timely intervention and support for at - risk students; 4. Threat alerts, which shall identify potentially dangerous activities or discussions online, and help to prevent school violence and harm to stude nts; and 5. Monitoring student online behavior, which shall employ digital safety solutions to monitor an d report online behavior of students while safeguarding their privacy. The monitoring shall be conducted in English and Spanish. C. The digital safety policies adopted and implemented pursuant to subsection B of this section shall: 1. Ensure there is strict data privacy and protecti on measures in compliance with all applicable laws an d regulations. Personally identifiable information of students shall be safeguarded; 2. Incorporate transparent processes for collecting and using data with informed consent from parents or guardians of students. The school shall clearly communicate how data is collected and utilized for digital safety pu rposes; and 3. Provide parents with the option to manage their student 's online activity while using school -issued devices at home. D. Public school districts shall annually report to the Department of Mental Health and Substance Abuse Services on the effectiveness of digital safety solutions in enha ncing digital safety, including data on incidents prevented, interventions made, and the impact on student well-being. Each school district's annual report shall be published on the Departme nt's website for public access. E. Subject to the availability of funds, the Department shall issue a request for proposal to select a vendor which will develop and implement the digital platform to be used by all public schools HB3277 HFLR Page 4 BOLD FACE denotes Committee Amendments. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 to adhere to the requirements of the Student Digital Safet y and Awareness Act. The Department shall oversee the selected vendor to ensure it is capable of meeting the requirements of th e Student Digital Safety and Awareness Act, the request for p roposal application, and any Department poli cies established to implement the Act, including all data components, digital safety , and privacy standards. The Department shall ensure all public schools comply with the Student Digital Safety and Awareness Ac t, including reviewing the schools' adopted policies and procedures and ensuring adherence to digital safety and privacy standards and utilization of the selected vendor. SECTION 2. This act shall become effective July 1, 2024. SECTION 3. It being immediately necessary for the preservation of the public peace, health or safety, an emergency i s hereby declared to exist, by reason whereof thi s act shall take effect and be in full force from and after its pas sage and approval.
