COMMITTEE SUBSTITUTE
An Act relating to schools; defining term; requiring
certain schools to make menstrual products available
at no cost to students; providing for easily
accessible location of products; directing adoption
of certain policies and procedures; requiring
submission of annual report to the State Department
of Education; authorizing State Board of Education to
promulgate rules; providing for codification; and
providing an effective date .
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 1-116.4 of Title 70, unless
there is created a duplication in numbering, reads as follows:
A. As used in this section, "menstrual products" means tampons
and sanitary napkins for use in connection with the menstrual cycle
that conform with applicable industry standards.
B. Every public school or charter school in th e state with
grades below grade six shall make menstrual products available at no
cost to students, in at least one neutral location that is easily

accessible to all stude nts and does not stigmatize any student
seeking the products, such as a school nurse 's office or
administrative office, as appr opriate.
C. Every public school or charter school in t he state with
grades six through twelve shall make menstrual products avai lable at
no cost to students, in easily accessible locations that do not
stigmatize any student seeking such products, including in the
school bathrooms. This shall include all female, single-use, and
standalone handicapped bathrooms accessed b y students in grades six
through twelve, as well as a neutral location, such as a school
nurse's office or administrative office, as appro priate.
D. Every school district board of education and public charter
school governing board shall adopt policies and procedures:
1. To ensure menstrual products are available and provided at
no cost to all students who need them. The policies shall include a
process by which students can provide grievances or other complaints
about lack of access to or quality of m enstrual products; and
2. To inform students of the availability of menstrual products
as provided in this section by including the policies and procedure s
adopted pursuant to this section in any student handbook and posting
the policies and procedures on school websites and locations in the
school where notices are commonly posted, including student
bathrooms and school nurses' offices.

E. No later than thirty (30) days following the end of each
fiscal year, every school district and charter school shall submit a
report to the State Department of Education containing the number of
menstrual products purchased in the preceding fiscal year, the
number of menstrual products distributed to students in the
preceding year, and any grievances or other complaints about lac k of
access to or quality of menstrual products. The reports shall be
made available for public inspection.
F. The State Board of Education sha ll promulgate rules to
implement the provisions of this section.
SECTION 2. This act shall be come effective November 1, 2024.
