AS INTRODUCED 
 
An Act relating to state government; creating the 
Oklahoma Tourism and Recreation Department State Park 
Emergency Maintenance Fund; estab lishing an Eight 
Year State Park Emergency Maintenance Plan; 
specifying sources of revenue for the fund; providing 
for expenditures from the fund; providing for 
codification; providing an effective date; and 
declaring an emergency. 
 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 2254.3 of Title 74, unless there 
is created a duplication in numberin g, reads as follows: 
A.  There is hereby created in the State Treasury a revolving 
fund for the Oklahoma Tourism and Recreation Department to be 
designated the "Oklahoma Tourism and Recreation Department State 
Park Emergency Maintenance Fund ".  The fund shall be a continuing 
fund, not subject to fiscal year limitations, and shall consist of 
all funds received by the Oklahoma Tourism and Recreation Department 
for the purposes of executing the Eight Year State Park Emergency

Maintenance Plan, as defined in th is section, and such other mo nies 
accredited to the fund pursuant to law. 
B.  All monies accruing to the credit of the fund are hereby 
appropriated and may be budgeted and expended by the Oklahoma 
Tourism and Recreation Department for the purpose of execut ing the 
Eight Year State Park Emergency Maintenance Plan, as defined in this 
section; provided, no more than twenty percent (20%) of the amount 
accruing annually shall be expended for the purpose of funding 
operations. 
C.  No monies from this revolving fun d shall be transferred for 
any purpose to any other state agency. Expenditures from the fund 
shall be made upon warrants issued by the State Treasurer against 
claims filed as prescribed by law with the Director of the Office of 
Management and Enterprise S ervices for approval and paym ent. 
D.  The Eight Year State Park Emergency Maintenance Plan is 
identified in the Appendix of this section and is incorporated by 
reference as if fully set out herein. 
E.  Any monies appropriated to the Oklahoma Tourism and 
Recreation Department State Par k Emergency Maintenance Fund shall 
not result in a decrease in historic and traditional Oklahoma 
Tourism and Recreation Department funding levels or be used to 
supplant or replace existing state funds used for state park 
maintenance purposes.

F.  In order to ensure proper oversight of the funds deposited 
in the Oklahoma Tourism and Recreation Department State Park 
Emergency Maintenance Fund, the Oklahoma Tourism and Recreation 
Department shall generate a report biannually identi fying funds 
expended and progress made on each project. The report shall be 
promptly submitted to the Governor, the President Pro Tempore of the 
Oklahoma State Senate, the Speaker of the Oklahoma House of 
Representatives, and all members of the Oklahoma T ourism and 
Recreation Commission. 
SECTION 2.  This act shall become effective July 1, 2024. 
SECTION 3.  It being immediately necessary for the preservation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reason whereo f this act shall take effect and 
be in full force from and after its passage and approval.
